TOWN AND COUNTRY PLANNING ACT 1990
The Secretary of State for Transport hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (County of Derbyshire) (No 1) Order 2003” authorising the stopping-up of a length of highway at Union Street, Long Eaton, Derbyshire, from the junction with Waverley Street in a north-easterly direction for a maximum length of 99 metres. The stopping-up is authorised only in order to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Carter Commercial Developments Ltd by the Erewash Borough Council on 6 April 2000 under Ref ERE/0899/0052. Copies of the Order may be obtained, free of charge, by applying to the Government Office for the East Midlands, Transport, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham NG1 5GG (quoting Ref EMCM 505035/1/244) and may be inspected at all reasonable hours at the offices of the Erewash Borough Council, Town Hall, Long Eaton, Derbyshire. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act, or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order may, within 6 weeks of 29 January 2003 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
