PROPOSED ASSOCIATED BRITISH PORTS (IMMINGHAM OUTER HARBOUR) HARBOUR REVISION ORDER

Notice is hereby given that application has been made to the Secretary of State for Transport, Local Government and the Regions (“the Secretary of State”) by Associated British Ports (“A B Ports”) for a Harbour Revision Order under section 14 of the Harbours Act 1964 for purposes of which the following is a concise summary— (1) To authorise A B Ports to construct and maintain works in the River Humber at the Port of Immingham. The works comprise: Work No 1—A bund commencing 70 metres south of the north eastern corner of the existing Humber International Terminal, extending in a south easterly direction and terminating at the existing flood defence wall north east of the Immingham Bulk Terminal Conveyor, together with a new sea wall and a reclamation of the foreshore of the river Humber on the landward side of the bund; Works Nos 2 to 6—five roll-on roll-off ramps each extending for 100 metres from the existing Humber International Terminal or the proposed bund; Work No 7—A line of dolphins consisting of mooring points and jetty protection connected by a walkway, commencing at the north eastern corner of the existing Humber International Terminal and running parallel to Work No 2 and the Immingham Bulk Terminal Jetty, together with jetty protection works at the south eastern end of the Immingham Bulk Terminal Jetty; Work No 8—A line of mooring dolphins connected by a walkway adjoining the end of either or both of Works Nos 3 and 4 and extending 230 metres in a south-easterly direction; Work No 9—A line of mooring dolphins connected by a walkway adjoining the end of either or both of Works Nos 5 and 6 and extending 230 metres in a south-easterly direction; Work No 10—Demolition and removal of the Western Jetty for a distance of 180 metres from its western end, together with the strengthening of the remaining part of the jetty and works to improve the berth on the south side of the jetty; and Work No 11—A quay adjoining the existing flood defence wall extending 400 metres south east from its junction with Work No 1. (2) To authorise the carrying out of within the limits of deviation for the works described above of subsidiary works including the dredging of the Outer harbour to a maximum depth of 10 metres below Chart Datum and the dredging of the approaches to a maximum depth of 9.1 metres below Chart Datum, strengthening works to the Immingham Bulk Terminal and works to channel, culvert or divert existing watercourses within Work No 1. (3) To make provision for other ancillary matters related to construction of tidal works and their lighting, buoying, abatement and survey both during and after construction. The Secretary of State has determined that the proposed works constitute a relevant project falling within Annex II to Council Directive 85/337/EEC as amended by Directive 97/11/EC as a result of being construction of a harbour and port installation where the area exceeds one hectare and its likely range of environmental impacts including effects on the SPA, combination effects of noise and disturbance from construction, and water quality changes. Accordingly an Environmental Statement will be submitted with the application. A copy of the draft Order, the plan and sections of the proposed works, the letter confirming the Secretary of State’s decision that the project is a relevant project under EC Directive 85/337/EEC and a copy of the environmental statement, and a copy of the appropriate assessment carried out by A B Ports under regulation 48(1) of the Conservation (Natural Habitats, &c.) Regulations 1994 may be inspected, free of charge, between the hours of 0900 and 1700 weekdays at the office of the Port Director, Port Office, Cleethorpe Road, Grimsby. A copy is also available for inspection between the hours of 0900 and 1600 Monday to Friday either at the Ports Division of the Department for Transport, Local Government and the Regions at Great Minster House, 76 Marsham Street, London SW1P 4DR or at the address of the undermentioned Solicitors and Parliamentary Agents. Such objections or representations should arrive no later than forty-two days from the date at the foot of this notice. An objection will not be valid unless (i) it is received by the due date, (ii) it is made in writing, (iii) it states the ground of objection, and (iv) it gives the objector’s name and address. The Secretary of State will pass to the applicant a copy of any objection or representation he receives.
