PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 SECTIONS 69 AND 70
EXTENSIONS TO BLACKHEATH CONSERVATION AREA, LONDON S.E.13.
This notice is given, pursuant to section 70 of the above Act. On 18th January 2001 the Council has determined that the areas described in the Schedule below (“the Extension Areas”) are areas of special architectural or historic interest, the character or appearance of which it is desirable to preserve or enhance. The Council has therefore designated the Extension Areas as additions to the existing Blackheath Conservation Area, London S.E.13. The effect of including the Extension Areas in the Blackheath Conservation Area is as follows: 1. Conservation area consent will now be required before the demolition of any unlisted buildings located in the Extension Areas (other than excepted buildings) can take place. 2. Planning applications for development in the Extension Areas, which would, in the Council’s opinion, affect the character or appearance of the Extension Areas, must be given publicity. Representations received as a result of that publicity must be taken into account in determining those applications. 3. Any person exercising any functions, under or by virtue of certain legislation (the Planning Acts, the Historic Buildings and Ancient Monuments Act 1953, and sections 70 and 73 of the Leasehold Reform, Housing and Urban Development Act, 1993) in respect of land in the Extension Areas, is under a duty to pay special attention to the desirability of preserving or enhancing the areas’ historic character or appearance. 4. It is an offence, subject to certain exceptions, to cut down, top, lop, uproot, wilfully damage or wilfully destroy, any tree in the Extension Areas except with the prior written consent of the Council. 5. The Council is now under a duty to formulate and publish proposals for the preservation and enhancement of the Extension Areas. 6. Permitted development rights for development in the Extension Areas are more restricted than before (persons wishing to exercise those rights within the Extension Area should first check the extent to which they may do so with the Council’s Planning Department). 7. The display of certain types of illuminated advertisement (namely those at Clauses 4A and 4B of Schedule 3 to the Town and Country Planning (Control of Advertisements) Regulations 1992) in the Extension Areas will require express advertisement consent.
