LIMITED PARTNERSHIP ACT 1907 PURSUANT TO SECTION 10

Notice is hereby given that a purported transfer of part of Foreign & Colonial Enterprise Trust PLC’s interest in Charterhouse Capital Partner V LP No. 3, notified in The London Gazette on Monday, 18th January 1999, was not valid and effective and that accordingly no such transfer was effected and Foreign & Colonial Enterprise Trust PLC is, and has always been, a Limited Partner in respect of its entire interest in the Partnership from the date of its initial admission to the Partnership.
