Old Kingston Road, Closures
Notice is hereby given that the Council of the Royal Borough of Kingston-upon-Thames on 24th September 1998, made the above-mentioned Order under section 6 of the Road Traffic Regulation Act 1984 (as amended). The general effect of the Order, which will come into operation on 5th October 1998, will be to prohibit any vehicle from entering those lengths of Old Kingston Road which lie: (a) between a point 42.65 metres south-east of a point opposite the south-eastern flank wall of No. 7 Old Kingston Road and a point 1.5 metres south-east of that point; (b) between a point 33.95 metres north-east of a point opposite the common boundary of Nos. 3 and 4 Tolworth Court Farm Cottages, Old Kingston Road and a point 1.5 metres north-east of that point. The prohibition referred to in this notice shall not apply to: (a) any vehicle being used for fire brigade, ambulance or police purposes in an emergency; (b) a vehicle being used in the service of a local authority for the purpose of exercising any statutory powers or performing any statutory duties in the prohibited area, (d) a vehicle being used in connection with any building operation, demolition or excavation in or adjacent to the prohibited area, the maintenance, improvement or reconstruction of the highway in or adjacent to the prohibited area; the laying, erection, alteration or repair in or adjacent to the prohibited area of any sewer, main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus, or the placing, maintenance or removal of any traffic sign, provided that in all the circumstances it is reasonably necessary for the vehicle to enter the prohibited area. (e) anything done with the permission or at the direction of a police constable in uniform; (f) anything done in accordance with the restriction or requirement indicated by traffic signs placed on the highway by or on behalf of the Metropolitan police. A copy of the Order, a plan which indicates the location and effect of the Order, a copy of the press notice and the Council’s statement of reasons for making the Order may, be inspected until 6th November 1998, at the 2nd Floor Reception area, Guildhall 2, Kingston-upon-Thames KT1 1EU, (between 9.30 a.m. and 4.30 p.m., on Mondays to Fridays inclusive). Copies of the Order may be obtained from the Directorate of Environmental Services (Engineering and Transportation), Guildhall 2, Kingston-upon-Thames KT1 1EU. Any person desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or that any of the relevant regulations made thereunder have not been complied with in relation to the Order may, within 6 weeks of the making of the Order make application for the purpose to the High Court.
