TOWN AND COUNTRY PLANNING ACT 1990
Highway at Wharf Street and part of Portland Street, Aston, Birmingham
The Secretary of State for the Environment, Transport and the Regions hereby gives
notice that he has made an Order, under section 247 of the above Act, entitled “The
Stopping-up of Highways (City of Birmingham) (No. 11) Order 1998” authorising the
stopping-up of the entire length of Wharf Street and part of Portland Street, Aston,
Birmingham, and requiring the provision of new highway shown as stippled on the deposited
plan.
The Order as made, will authorise the stopping-up only to enable the development
described in the Schedule to this notice to be carried out in accordance with the
planning permission granted by Birmingham Heartlands Development Corporation on 12th
August 1997, under Ref. H/02615/97/FUL.
Copies of this Order may be obtained, free of charge, on application to the Government
Office for the West Midlands, at the offices of the Director, Planning, Transport
and Environment, 77 Paradise Circus, Queensway, Birmingham B1 2DT, (quoting 5104/35/1/117)
and may be inspected at all reasonable hours at the offices of Birmingham City Council,
Baskerville House, Broad Street, Birmingham BN1 2NA.
Any person aggrieved by the Order and desiring to question the validity thereof,
or of any provison contained therein, on the grounds that it is not within the powers
of the above Act or that any requirement of that Act or any regulation made thereunder
has not been complied with in relation to the Order, may, within 6 weeks of 18th September
1998, apply to the High Court for the suspension or quashing of the Order or of any
provision contained therein.
