Black Down and Sampford Commons (Devon and Somerset) Nature Conservation Order 1997

Notice is hereby given, under paragraph 6 of Schedule 11 of the Wildlife and Countryside Act 1981, that the Secretary of State, having considered the objections and representations duly made in respect of the above-named Order and the report of the person appointed to hold a public inquiry, has considered the above-named Order and does not propose to amend or revoke it. In consequence, the Order which took effect on 30th October 1997 will continue in effect.   The general effect of the Order is to impose restrictions on the carrying out of certain operations specified in the Order on land described in the Order (which is Black Down and Sampford Commons Site of Special Scientific Interest which is situated within the counties of Somerset and Devon, the exact delineation of which is set out on the plan referred to in the Order).   Copies of the Order and map referred to in it, and of this notice have been deposited at the offices of the Mid Devon District Council, Ailsa House, Tidcombe Lane, Tiverton, Devon EX16 4DZ, and the Taunton Deane Borough Council, The Deane House, Belvedere Road, Taunton, Somerset TA1 1HE. They may be seen, free of charge, at all reasonable hours.   Any person who is aggrieved by the Order and desires to question its validity on the grounds that it is not within the powers of section 29 of the said Act of 1981, or that any of the requirements of Schedule 11 of that Act had not been complied with in relation to it, may, within 6 weeks from the date of this notice, make an application to the High Court under paragraph 7 of Schedule 11 to the 1981 Act.
