Hounslow West—Parking Scheme

Notice is hereby given that the Council of the London Borough of Hounslow on 22nd June 1998 made the following Orders:   (a) the Hounslow (Parking Places) (No. 2) Order 1998 under sections 45, 46 and 49 of the Road Traffic Regulation Act 1984 (as amended);   (b) the Hounslow (Waiting and Loading Restriction) (Amendment No. 100) Order 1998 under sections 6 and 124 of and Part IV of Schedule 9 to the aforementioned Act of 1984 and the Road Traffic Act 1991; and   (c) the Hounslow (Loading Places) (No. 1) Order 1998 under section 6 of the Act of 1984; and   (d) the Hounslow (Restriction of Waiting on Bus Stops) (Amendment No. 1) Order 1998 under section 6 of the Act of 1984.   2. The general effect of the Orders would be to impose a system of parking control in the streets or parts of streets in the Hounslow West Area specified in Schedules 1, 2, 3, 4, 5 and 6 to this notice.   3. The general effect of the Parking Places Order will be to:   (a) designate parking places on the highway specified in column 1 of Schedule 2 to this notice at which charges may be made by the Borough Council for vehicles authorised by the Order to be left in those parking places and provides that the type of parking place so designated will be as set out in column 2 of that Schedule;   (b) provide that the parking places will operate betwen 9.30 a.m. and 5.30 p.m. on Mondays to Fridays and betwen 9.30 a.m. and 12.30 p.m. on Saturdays (Christmas Day, Good Friday and Bank Holidays excepted);   (c) specify in respect of the parking meter and ticket parking meter parking places, that passenger vehicles (12 seats or less), goods carrying vehicles, motor cycles and invalid carriages may be left therein and, in respect of the residents’ and business parking places, that vehicles displaying a valid permit in a protective cover issued by the Borough Council may be left therein;   (d) provide that the permits and protective covers will be issued by the Borough Council:       (i) on application being made, together with payment of the appropriate charge, for a residents parking permit by any person residing in the controlled area who is the owner of a passenger vehicle (12 seats or less), a goods carrying vehicle not more than 2.28 metres in height, a motor cycle or an invalid carriage;       (ii) on application being made, together with payment of the appropriate charge, for a business parking permit by any person who occupies premises in the controlled area and who uses such premises for non-residential purposes and who is the owner of a passenger vehicle (12 seats or less), a goods carrying vehicle not more than 2.50 metres in height and the overall length of which does not exceed 5.25 metres or a motor cycle;   (e) specifies that:       (i) in the parking meter parking places, the charge will be at the rate of 20p per 20 minutes and the maximum period of stay would be 2 hours;       (ii) in the ticket parking metered parking places, the charge will be at the rate of 20p per 20 minutes with a maximum period of stay of 5 hours;       (iii) in respect of the residents’ parking places, the charge for permits will be £30 for 12 months and £10 for a Saturdays only permit running from the beginning of the month in which they are issued;       (iv) in respect of the busines parking places, the charge for a permit will be £400 for permits issued for 12 months running from the beginnings of the month in which they are issued;       (v)  in respect of residents’ visitors, a maximum of 6 booklets of vouchers per year per household may be purchased at a cost of £5 per booklet;       (vi) in respect of the parking meter and ticket parking meter parking places, permit parking places and shared use parking places the Penalty Charge—payable to the Borough Council—would be £40 (or £20 if paid within 14 days), the unexpired time on a parking meter may be used free of charge and the period during which a vehicle may not return to a parking place will be 1 hour;   (f) provides that certain vehicles may wait free of charge in certain circumstances, e.g., to allow persons to board or alight (maximum 2 minutes), to load or unload (maximum 20 minutes).   4. The general effect of the Waiting and Loading Restriction Order will be to further amend the Hounslow (Waiting and Loading Restriction) Order 1977 so that:   (a) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle will be prohibited between 9.30 a.m. and 5.30 p.m. on Mondays to Fridays and between 9.30 a.m. and 12.30 p.m. on Saturdays inclusive in the streets or parts of streets specified in Schedule 3 to this notice;   (b) waiting by vehicles for the purposes of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will be prohibited between 11 a.m. and 6.30 p.m. on Mondays to Fridays in the streets or parts of streets referred to in sub-paragraph 4(a) above;   (c) the sale or offer for sale of goods from a vehicle in the streets or parts of streets referred to in sub-paragraph 4(a) above will be prohibited unless there is in force a valid licence issued by the Hounslow Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;   (d) (i) the existing restriction on waiting by vehicles in the streets or parts of streets mentioned in Schedule 4 to this notice will be varied to operate between 9.30 a.m. and 5.30 p.m. on Mondays to Fridays and between 9.30 a.m. and 12.30 p.m. on Saturdays;       (ii) the existing restriction on waiting by vehicles in the streets or parts of streets mentioned in Schedule 5 to this notice will be varied to operate between 7 a.m. and 7 p.m. throughout the week; and       (iii) the existing restriction on waiting by vehicles in the streets or parts of streets mentioned in Schedule 6 to this notice will be varied to operate between 7 a.m. and 7 p.m. on Mondays to Saturdays inclusive.   5. The prohibitions referred to in paragraphs 4(a) and (b) above, will not apply in respect of anything done with the permission or at the direction of a parking attendant or a police constable in uniform or in certain circumstances, e.g., the picking-up or setting down of passengers, the carrying out of statutory powers or duties, the taking in of petrol, etc., from roadside petrol stations, to licensed street traders etc. The usual exemption relating to vehicles displaying a disabled persons’ “Orange Badge” will apply.   6. The general effect of the Loading Places Order will be to designate a parking place for use only by goods carrying vehicles to wait for the purpose of loading or unloading for a period not exceeding 20 minutes in Rosemary Avenue, the south-eastern arm, the south-east side, from a point 12 metres north-east of a point opposite the south-western boundary of No. 302 Bath Road, Hounslow north-eastwards for a distance of 18 metres.   7. The general effect of the Restriction of Waiting on Bus Stops Order will be to prohibit vehicles, other than buses, from stopping “at any time” throughout the week in Vicarage Farm Road, the north-west side, from a point 13.90 metres south-west of a point opposite the south-western side of the footpath linking Vicarage Farm Road and Dalcross Road south-westwards for a distance of 19 metres.   8. A copy of the Orders, which shall come into operation on 29th June 1998, of the above-mentioned Order of 1977 (and of the Orders which have amended that Order) and of a map which indicates the lengths of roads to which the Orders relate can be inspected during normal office hours on Mondays to Fridays inclusive until the end of 6 weeks from the date on which this notice is published in the Environmental Services Reception Area at the Civic Centre, Lampton Road, Hounslow TW3 4DN.   9. Copies of the Orders may be purchased from the Environmental Services Department, of the London Borough of Hounslow, Civic Centre, Lampton Road, Hounslow TW3 4DN.   10. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that they are not within the relevant powers of the Road Traffic Regulation Act 1984, as amended, or that any of the relevant requirements have not been complied with in relation to the Orders may, within 6 weeks of the date on which the Orders were made, make application to the High Court for the purpose.
