TOWN AND COUNTRY PLANNING ACT 1990
Highways at Flavell Avenue/Cox Road, Coseley, Dudley
The Secretary of State for the Environment, Transport and the Regions, hereby gives
notice that he has made an Order under section 247 of the above Act entitled “The
Stopping-up of Highways (Metropolitan Borough of Dudley (No. 3) Order 1998” authorising
the stopping-up of a length of footway at Cox Road, Coseley and the stopping-up of
public footpath C104 and requiring the provision of a new footpath shown as thick
black hatching on the deposited plan and the improvement of existing highway shown
as cross hatched on the deposited plan.
The Order as made, will authorise the Stopping-up only to enable the development
described in the Schedule to this notice to be carried out in accordance with the
planning permission granted by Dudley Metropolitan Borough Council on 20th March 1998,
under Ref. 96/51523.
Copies of this Order may be obtained, free of charge, on application to the Government
Office for the West Midlands at the offices of the Director, Planning, Transport and
Environment, 77 Paradise Circus, Queensway, Birmingham B1 2DT (quoting 5106/35/1/7)
and may be inspected at all reasonable hours at the offices of Dudley Metropolitan
Borough Council, Council House, Mary Stevens Park, Stourbridge DY8 2AA.
Any person aggrieved by the Order and desiring to question the validity thereof,
or of any provision contained therein, on the grounds that it is not within the powers
of the above Act or that any requirement of that Act or any regulation made thereunder
has not been complied with in relation to the Order, may within 6 weeks of 10th June
1998, apply to the High Court for the suspension or quashing of the Order of any provision
contained therein.
