ROADS (SCOTLAND) ACT 1984
THE A96 TRUNK ROAD (THREAPLAND JUNCTION IMPROVEMENTS)
ENVIRONMENTAL STATEMENT
THE SCOTTISH MINISTERS, as the relevant roads authority, are considering implementing the following project.
The A96 Trunk Road (Threapland Junction Improvements) is a proposed junction improvements scheme, the general effect of which will be to provide for the construction of new side roads, the improvement of certain existing lengths of road to form new and improved connections in relation to the new roads, the provision of a length of temporary road, the stopping up of various lengths of existing roads, the stopping up of private means of access and the provision of certain new means of access.
THE SCOTTISH MINISTERS, give notice that the project is subject to the environmental impact assessment procedure prescribed by sections 20A and 55A of the Roads (Scotland) Act 1984 as amended and they have prepared an Environmental Statement in accordance with the provisions of that Act as amended.
A COPY of the Environmental Statement may be inspected, free of charge, from 14th October 2008 to 5th December 2008 at:-

COPIES of the Environmental Statement can also be obtained during the time period above from Transport Scotland, Buchanan House, 58 Port Dundas Road, Glasgow G4 0HF at a charge of £150.00 for a hard copy or £15.00 for the CD. Requests for further information about the project may be sent to the same address during the same period.
A COPY of the Environmental Statement is also available for inspection on Transport Scotland’s website at www.transportscotland.gsi.gov.uk
ANY PERSON wishing to make any representations about the project and the addendum to the Environmental Statement, may do so in writing, to David Pollock, Transport Scotland, Major Transport Infrastructure Projects, Buchanan House, 58 Port Dundas Road, Glasgow G4 0HF quoting reference OTG/1590/1. Any such representations must be received on or before 5th December 2008.
THE SCOTTISH MINISTERS will take into consideration any representations so made before deciding whether or not to proceed with the project with or without modifications.

ENVIRONMENTAL IMPACT ASSESSMENT
DETERMINATION BY THE SCOTTISH MINISTERS UNDER SECTIONS 20A AND 55A OF THE ROADS (SCOTLAND) ACT 1984
The Scottish Ministers hereby give notice that they have determined that their proposal to improve a section of the A96 Inverness to Aberdeen Trunk Road east of Lhanbryde, Moray in the vicinity of Threapland Junction:
(a) is not a project which falls within Annex I of the Council Directive No. 85/337/EEC on the assessment of the effects of certain public and private projects on the environment as amended by Council Directive No. 97/11/EC and Council Directive No. 2003/35/EC of the European Parliament and Council;
(b) is a relevant project within the meaning of Sections 20A(9) and 55A(7) of the Roads (Scotland) Act 1984 and falls within Annex II of the said Directive and having regard to the selection criteria contained in Annex III of the said Directive it should be made subject to an environmental impact assessment in accordance with the said Directive, and accordingly the project does require an Environmental Statement.

NOTICE IS HEREBY GIVEN, that the Scottish Ministers propose to make the above Order under sections 12(1) and (5) and 70(1) of the Roads (Scotland) Act 1984, the general effect of which will be to provide for the construction of new side roads, the improvement of certain existing lengths of road to form new and improved connections in relation to the new roads, the provision of a length of temporary road, the stopping up of various lengths of existing roads, the stopping up of private means of access and the provision of certain new means of access.

THE A96 TRUNK ROAD (THREAPLAND JUNCTION IMPROVEMENTS) (REDETERMINATION OF MEANS OF EXERCISE OF PUBLIC RIGHT OF PASSAGE) ORDER 200[ ]
NOTICE IS HEREBY GIVEN that the Scottish Ministers propose to make an Order under sections 2(1) and 152(2) of the Roads (Scotland) Act 1984, redetermining the means of exercise of the public right of passage over the lengths of road described in the Schedule hereto.
The title of the Order is the “A96 Trunk Road (Threapland junction improvements) (Redetermination of Means of Exercise of Public Right of Passage) Order 200[ ]”.

ANY PERSON may, within 28 days from 14th October 2008, object to the making of the Order, by notice in writing, to David Pollock, Transport Scotland, Major Transport Infrastructure Projects, Buchanan House, 58 Port Dundas Road, Glasgow G4 0HF quoting reference OTG/1590/6. Objections should state the name and address of the objector, the matters to which they relate and the grounds on which they are made.
SCHEDULE
INTERPRETATION
In this Schedule:
“the plan folio” means the plan folio numbered OTG/1590/6 signed with reference to this Order and deposited at the offices of Transport Scotland, Buchanan House, 58 Port Dundas Road, Glasgow, G4 0HF.
“the Trunk Road” means the A96 Inverness to Aberdeen Trunk Road.
“point 1” means the point of intersection of the existing centrelines of the existing Trunk Road and Loch Oire Road, as shown on Plan RD1 in the Plan Folio.
ROADS OVER WHICH MEANS OF EXERCISE OF PUBLIC RIGHT OF PASSAGE IS TO BE REDETERMINED
The length of road shall become a cycle track, the right of passage being exercisable by pedal cycle and foot only. The public right of passage over the length of road at present is exercisable by whatever means.
1. That length of road from a point 405 metres or thereby west south west of point 1, to a point 302 metres or thereby west south west of point 1, generally in a east north easterly direction for a distance of 105 metres or thereby, as shown by saw-tooth and marked “A” on plan RD1 in the plan folio.
2. That length of road from a point 390 metres or thereby west south west of point 1, to a point 200 metres or thereby west south west of point 1, generally in a east north easterly direction for a distance of 190 metres or thereby, as shown by saw-tooth and marked “B” on plan RD1 in the plan folio.
3. That length of road from a point 193 metres or thereby west south west of point 1, to a point 157 metres or thereby west south west of point 1, generally in a east north easterly then south easterly direction for a distance of 41 metres or thereby, as shown by saw-tooth and marked “C” on plan RD1 in the plan folio.
4. That length of road from a point 144 metres or thereby west south west of point 1, to a point 12 metres or thereby south of point 1, generally in a north easterly then east north easterly then easterly direction for a distance of 146 metres or thereby, as shown by saw-tooth and marked “D” on plan RD1 in the plan folio.
5. That length of road from a point 12 metres or thereby south south east of point 1, to a point 16 metres or thereby south south east of point 1, generally in a south south easterly direction for a distance of 4 metres or thereby, as shown by saw-tooth and marked “E” on plan RD1 in the plan folio.
