Company Director Disqualification Order

COMPANY DIRECTORS DISQUALIFICATION ACT 1986

In a summary application presented to Kilmarnock Sheriff Court in terms of Section 7 of the above Act at the instance of Her Majesty’s Secretary of State for Trade and Industry in respect of Sean Graham, formerly residing at 5 Carlung House, West Kilbride, Ayrshire KA23 9PU and 10 Ailsa View, West Kilbride, Ayrshire GA23 9CA and now residing at 9 Fullerton Drive, West Kilbride KA23 9HF. Sheriff Thornton on 31 March 2006 ordered the following:-

Sustains the pursuer’s pleas-in-law and Repels the defender’s pleas-in-law; Makes a disqualification order under Section 6(1) of the Company Directors Disqualification Act 1986 against the defender that he shall not, without leave of the court, be a director of a company, or be a liquidator of a company, or be a receiver or manager of a company’s property, or in any way, whether directly or indirectly, be concerned in or take part in the promotion, formation or management of a company for a period of three years commencing at the end of the period of 21 days beginning with the date of this order; Directs that the making of the said disqualification order be registered by the Secretary of State for Trade and Industry; Appoints the pursuer to make intimation of the order within 21 days of this date once in The Edinburgh Gazette and once by advertisement in a newspaper circulating in the area in which the premises at 58-62 Hamilton Street, Saltcoats are situated; Finds the defender liable to the pursuer in the expenses of process; Appoints an account thereof to be given in and remits the same, when lodged, to the Auditor of the Court to tax and to report.
