Company Director Disqualification Order
COMPANY DIRECTORS DISQUALIFICATION ACT 1986
Ian Thomas Faulds, of 51 Ashgrove Avenue, Maybole, Ayrshire has given a disqualification undertaking, which has been accepted by the Secretary of State in terms of Section 1(A) and 7(2A) of the Company Directors Disqualification Act 1986, that he shall not be a director of a company, act as a receiver of a company’s property or in any way, whether directly or indirectly, be concerned or take part in the promotion, formation or management of a company unless (in each case) he has the leave of the court, and he shall not act as an insolvency practitioner for a period of 4 years commencing on 23rd October 2003.
In a motion presented to the Sheriff Court at Ayr in terms of Section 17 of the above Act at the instance of Ian Thomas Faulds, the Sheriff pronounced the following:
“The Sheriff having heard parties’ agents on Defender’s Motion, no 7/2 of Process, Grants same and in terms thereof, Grants leave to the Defender, in terms of Section 17 of the Company Directors Disqualification Act 1986, to be a director and be concerned in the promotion and management of Carrick Construction Limited, a company registered under the Companies Acts and having its registered office at 51 Ashgrove Avenue, Maybole, Ayrshire, KA19 8BJ registered in Scotland under Company no SC215564 for a period of 12 months from 23rd October 2003 upon such condition referred to in the Proposed Conditions no 10 of Process; quoad ultra Dismisses the cause and finds no expenses due to or by either party,”
