(STOPPING UP) ORDER 2002

TCP/02/01

Notice is hereby given that on 18th November 2002 The West Lothian Council made an Order under Section 207 of the Town and Country Planning (Scotland) Act 1997 stopping up the road described in the Schedule below, being satisfied that it has become necessary to authorise the stopping up of the said length of road in order to facilitate change of use from public open space to private garden ground to be carried out in accordance with planning permission granted under Part III of the said 1997 Act.

The title of the Order is “The West Lothian Council (Footpath Behind Nos 1 to 5 Brackensbrae, Broxburn) (Stopping Up) Order 2002”.

A copy of the Order and of the related plan showing the road to be stopped up, together with a statement of the reasons for making the Order have been deposited at West Lothian Council Headquarters, West Lothian House, Almondvale Boulevard, Livingston and Broxburn Area Office, 99 East Main Street, Broxburn. These documents are available for inspection free of charge from 21st November until 20th December 2002 during the hours of 9.00 am and 4.30 pm Mondays to Fridays inclusive. Further information about the proposals may be obtained from the Planning Manager on 01506 775218.

Any person may, within 28 days from 18th November 2002, object to the making of the Order prior to its confirmation by notice in writing, quoting reference TCP/02/01, to The Legal Services Manager, West Lothian House, Almondvale Boulevard, Livingston. Objections should state the name and address of the objector, the matters to which they relate and the grounds on which they are made. Alternatively objections may be e-mailed to susan.wales@westlothian.gov.uk, provided such objectors quote their full name and postal address.

Length of Road in Broxburn to be Stopped Up

That part of the footpath to the rear of numbers 1 to 5 Brackensbrae, from a point 28 metres west of its junction with Brackensbrae southwards for a distance of 9.5 metres or thereby, having a width of 3.8 metres or thereby narrowing to 1.2 metres or thereby, thence eastwards for a distance of 10 metres or thereby, having a width of 6.5 metres or thereby narrowing to 3.5 metres or thereby.
