THE PLANNING (2011 ACT) (TRANSITIONAL PROVISIONS) ORDER (NORTHERN IRELAND) 2011
The Department of the Environment has made a Statutory Rule, the Planning (2011 Act) (Transitional Provisions) Order (Northern Ireland) 2011 (S.R. 2011 No. 387), which comes into operation on 1 December 2011.
This Rule provides for transitional provisions in connection with the commencement of section 248 of the Planning Act (Northern Ireland) 2011 which amends the time periods for enforcement under the Planning (Northern Ireland) Order 1991. Section 248 provides for a new 5 year time period for enforcement (instead of 4 and 10 years). Article 2 of this Rule sets out how enforcement cases will be handled by the Department where enforcement action has been initiated under the Planning (Northern Ireland) Order 1991 at the time the new period is introduced.
