THE WASTE (AMENDMENT) (2007 ORDER) (COMMENCEMENT No. 1) ORDER (NORTHERN IRELAND) 2007

Notice is hereby given that in exercise of the power conferred on it by Article 1(3) of the Waste (Amendment) (Northern Ireland) Order 2007 (“the 2007 Order”), the Department of the Environment has made the Waste (Amendment) (2007 Order) (Commencement No. 1) Order (Northern Ireland) 2007 (“the Commencement Order”).

The Commencement Order brings several provisions of the 2007 Order into operation on 25th June 2007.

The Articles of the 2007 Order brought into operation from that date on include those on the defence of acting under an employer’s instructions, penalties on conviction, investigation and enforcement costs, clean-up costs, forfeiture of vehicles, and the daily fine for an offence under Article 27 of the Waste and Contaminated Land (Northern Ireland) Order 1997 (“the 1997 Order”).

Articles concerning the power to require an owner of land to remove waste, the powers of enforcing authorities, and the power to stop vehicles, will also be in operation from 25th June 2007 onwards.

Some of the repeals of the 1997 Order, as detailed in Article 20 of the 2007 Order, will also be commenced on that date.
