Department of Enterprise, Trade and Investment

Notice is hereby given that the Department of Enterprise, Trade and Investment, in exercise of its powers under Article 45(9) of the Energy (Northern Ireland) Order 2003 No. 419 (N.I. 6) (“the Energy Order”), has made a Statutory Rule entitled the “Electricity and Gas (Determination of Turnover for Penalties) Order (Northern Ireland) 2005 No. 287”.

The Rule determines how the turnover of an electricity or gas licence holder is to be calculated for the purposes of calculating the upper limit of any penalty imposed by the Authority on the licence holder. The Rule provides for the relevant turnover of the licence holder to be calculated in accordance with normal accounting practice in Northern Ireland. The Rule will come into operation on 20 July 2005.
