Department of the Environment
The Department of the Environment has made a Statutory Rule entitled The Marketing and Use of Dangerous Substances (No. 3) Regulations (Northern Ireland) 2004 (S.R. 2004 No. 302).
The rule comes into operation on 17 January 2005.
The rule gives effect to the nonylphenol and nonylphenol ethoxylate sections of European Commission Directive 2003/53/EC amending for the 26th time Council Directive 76/769/EEC relating to restrictions on the marketing and use of certain dangerous substances and preparations. (nonylphenol, nonylphenol ethoxylate and cement).
The rule is made under section 2(2) of the European Communities Act 1972. It restricts the use of nonylphenol and nonylphenol ethoxylate in concentrations equal or higher than 0.1% by mass. Specified derogations apply. The rule makes it a criminal offence to contravene this and specifies penalties for such an offence.
