NOTICE UNDER ARTICLE 14(2) OF THE ELECTRICITY (NORTHERN IRELAND) ORDER 1992

In pursuance of his powers under Article 14(1) of the Electricity (Northern Ireland) Order 1992 (hereinafter referred to as the “Order”), the Director General of Electricity Supply for Northern Ireland, having obtained the consent of the licensee in question, hereby gives notice as follows:

1. He proposes to make modifications to the Conditions applicable to each of the Transmission Licence and the Public Electricity Supply Licence granted to Northern Ireland electricity plc under Article 10(1) of the Order. The modifications applicable to each of the Transmission Licence and the Public Electricity Supply Licence are to: Condition 2 Part II (Interpretation and construction), Condition 8 Part II (Disposal of relevant assets), Condition 9 Part II (Restriction on use of certain information) and Condition 20 Part II (Prohibited activities and ring-fencing). The modifications applicable to the Transmission Licence are to Condition 9 Part III (Transmission System Operation).

2. The purpose of the licence modifications is to enable NIE to carry out the TSO business through its subsidiary SONI Limited and to secure greater transparency in relation to the transmission system operation on a way which is consistent with the requirements of the IME Directive 96/92/EC.

3. A copy of the proposed modifications can be viewed during office hours (9.00 am - 5.00 pm) and, if required, can be obtained (free of charge) from the Office for the Regulation of Electricity and Gas, Brookmount Buildings, 42 Fountain Street, Belfast BT1 5EE (Telephone: 02890-311575; Fax: 02890-311740).

4. The purpose of this notice is to bring to your attention the proposed modifications referred to above and to invite you to make any representations or raise any objections you may have to those proposed modifications. Any such representations or objections to the proposed modifications should be made on or before 20th September 2002 to the Office for the Regulation of Electricity and Gas, Brookmount Buildings, 42 Fountain Street, Belfast BT1 5EE (Telephone: 02890-311575; Fax: 02890-311740).

5. Pursuant to Article 14(3) of the Order, the Director has served a copy of this notice on NIE, and pursuant to Article 14(4) of the Order, the Director has sent a copy of this notice to the Department of Enterprise, Trade and Investment.
