NOTICE OF VARIATION OF THE MARKET PLACE CONSERVATION AREA

PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (AS AMENDED)

Preston City Council (“the Council”) hereby gives Notice in accordance with section 70 of the Planning (Listed Buildings and Conservation Areas) Act 1990 (as amended), that on 13 August 2025, it determined a boundary change to the Market Place Conservation Area. This followed a public consultation on the Market Place Conservation Area Appraisal between 2 May 2025 and 13 June 2025.

The boundary changes are two-fold in that:

1. The boundary is extended to include Lancastria House on Lancaster Road, Preston, PR1 2QH; and

2. The boundary is reduced in that the properties specified in the Schedule to this Notice have been removed from the Market Place Conservation Area. The main effects to those properties so specified in the said Schedule are that –

o the local planning authority (and the Secretary of State) in carrying out their functions under the Planning Acts and in-particular in determining applications for planning permission) are no longer required to take into account the desirability of preserving or enhancing the character or appearance of the Conservation Area, save in respect of determining such applications in relation to land / property close to the Conservation Area boundary;

o they will benefit from all permitted development rights under Schedule 2 of the Town and Country (General Permitted Development) (England) Order 2015;

o prior notice under section 211 of the Town and Country Planning Act 1990 is no longer required to be served on the local planning authority before carrying out proposed works on a tree.

However, if a tree is protected by a Tree Preservation Order no person shall cut down, top, lop, uproot, wilfully damage or destruct any tree protected by a Tree Preservation Order except with the written consent of the Council or Secretary of State as appropriate and where said consent is given subject to conditions, in accordance with those conditions.

THE SCHEDULE

The following properties are now excluded from the Market Place Conservation Area:

• Land north of Market Hall, front of former Indoor Market, Preston, PR1 2LA

• Land at the rear of 50-60 Lancaster Road (formerly 3-5 Lords Walk), Preston, PR1 1DN

• Unit 2, Lowthian House, Market Street, Preston, PR1 2ES

• 12 Friargate, Preston, PR1 2AU

• 13 Friargate, Preston, PR1 2AU

• 14 Friargate, Preston, PR1 2AU

• St Georges Shopping Centre 111-113, Friargate Walk, Preston, PR1 2NQ.
