THE ELECTRICITY GENERATING STATIONS (VARIATION OF CONSENTS) (ENGLAND AND WALES) REGULATIONS 2013 (“THE VARIATION REGULATIONS”) REGULATION 5(5)
SPALDING ENERGY EXPANSION GENERATING STATION AT WEST MARSH ROAD, SPALDING, LINCOLNSHIRE
Notice is hereby given that Spalding Energy Expansion Limited (‘SEEL’) (the ‘Applicant’) has applied to the appropriate authority, being the Secretary of State for Energy Security and Net Zero (‘Secretary of State’), to vary the consent granted consent granted 31st January 2018 under Section 36C of the Electricity Act 1989 (‘Section 36 Consent’) and the direction under Section 90 of the Town and Country Planning Act 1990 (‘Deemed Planning Permission’) for the construction and operation of a generating station of up to 945MW capacity comprising a Combined Cycle Gas Turbine (‘CCGT’) unit, a Battery Energy Storage System (‘BESS’), and an Open Cycle Gas Turbine (‘OCGT’) unit generating station, located at West Marsh Road, Spalding, Lincolnshire (‘the Site’). (Hereafter referred to as ‘the Variation Application’).
Consent was granted on 11th November 2010 (‘the Original Consent’) under Section 36 of the Electricity Act 1989 (‘Section 36 Consent’) and the direction under section 90(2) of the Town and Country Planning Act 1990 (‘Deemed Planning Permission’). A variation to the Original Consent Application was granted under Section 36C of the Electricity Act 1989 on 30th October 2015, and a direction that the conditions of the 2010 Deemed Planning Permission be varied was made (‘the Varied Consent and 2015 Deemed Planning Permission’). A subsequent variation application was approved on 31st January 2018.
The Variation Application requests that the Secretary of State in the exercise of his powers under Section 36C of the Electricity Act 1989 and Section 90 (2ZA) of the Town and Country Planning Act 1990 and varies the Section 36 Consent and Deemed Planning Permission in order to permit the construction and operation of either one combined cycle gas turbine (CCGT) unit and/or one open cycle gas turbine (OCGT) unit at the Site.
The Variation Application also seeks to amend the conditions pursuant to which the Section 36 Consent and Deemed Planning Permission was granted: to reflect the fact that construction of the OCGT unit is complete; to remove the permitted (up to 175MW) BESS component; to add Spalding Energy Park Limited in the definition of ‘the company’ and therefore as a second holder and beneficiary of any varied consent; and to reflect other changes in circumstances since the consent was granted.
On 13 March 2025, the Secretary of State notified that the Variation Application is suitable for publication, in accordance with Regulation 4(6).
