The Scottish Ministers, in exercise of the powers conferred by sections 35(7) and 37(3) of the Environmental Protection Act 1990 (the “1990 Act”) and regulation 60 of the Pollution Prevention and Control (Scotland) Regulations 2012 (the “2012 Regulations”), have issued a ministerial direction to the Scottish Environment Protection Agency (SEPA).

The Scottish Ministers have directed that existing and new waste management licences and PPC permits contain a condition requiring compliance with the Code of Practice on Sampling and Reporting at Materials Facilities issued on 24 June 2024 from 1 April 2025.
