NOTICE OF VARIATION OF THE ATWICK CONSERVATION AREA,
THE NORTH CAVE CONSERVATION AREA
AND SKIDBY CONSERVATION AREA
East Riding of Yorkshire Council (the council) hereby gives notice in accordance with Sections 69 & 70 of the Planning (Listed Buildings and Conservation Area) Act 1990 as amended, that on 28 February 2023 revised conservation area appraisals were adopted for the above three conservation areas.
These included boundary changes to the Atwick and Skidby Conservation Areas, as well as the retention of an Article 4 Direction in the Atwick Conservation Area. Changes to the boundary of the Atwick Conservation Area
1. The Removal of post-2000 developments which have been developed on the edge of the Conservation Area - Chapel Croft, Pengarth the adjoining property to the east, Hornsea Road and Primrose Cottage and Garden Cottage, Church Lane.
2. The addition of Field House (excluding the modern garage) on Church Lane.
3. Inclusion of land and trees to the north of Rose Farm.
4. Inclusion of land bounded by Canham Lane and Church Lane.
5. Inclusion of pre-1850 properties on Bewholme Road, including Westholme Cottage and The Cottage.
Changes to the boundary of the Skidby Conservation Area
1. The expansion of the boundary to the east of the village to include five further eighteenth-century vernacular buildings, including the Grade II listed farmstead 44 Main Street.
2. The amendment of the boundary to the north of the village to exclude the modern house and garage at 71 Main Street.
3. The extension of the boundary to include an outbuilding neighbouring 60 Main Street.
A Conservation Area is an area of special architectural or historic interest, the character of appearance of which it is desirable to preserve or enhance.
The principal effects of the designation of a conservation area are as follows:
1. It preserves or enhances the character and appearance of the conservation area as an area of special architectural or historic interest and the means that the council is under a duty to formulate proposals for its preservation or enhancement.
2. It means that, in carrying out its functions under the Planning Acts, the council is under a duty to pay special attention to the desirability of preserving or enhancing the character or appearance of those conservation areas.
3. It provides greater control over the demolition of buildings and structures within the conservation area.
It is a criminal offence to carry out demolition in a conservation area without planning permission.
4. It provides greater control over certain external works to dwelling houses, which would otherwise be “permitted development” as defined in the Town and Country Planning (General Permitted Development) (England) Order 2015.
5. It means that consent may be required for alterations, extensions or changes of use of shops, cafés, takeaways, financial services and offices etc.
6. It creates the requirement to apply for consent to carry out any works to trees within the conservation area and the requirement to provide six weeks notice in writing to the council before any such works are carried out.
It is a criminal offence to cut down, lop, top or uproot a tree in a conservation area without giving this written notice.
7. It places certain restrictions on the display of outdoor advertisements.
