ENVIRONMENTAL PROTECTION ACT (1990)
THE ENVIRONMENTAL PROTECTION (SINGLE-USE VAPES) (SCOTLAND) REGULATIONS 2024
Notice is hereby given that the Scottish Ministers intend to introduce legislation in accordance with section 140 of the Environmental Protection Act 1990 to prohibit the supply, in the course of business, of single-use vapes in Scotland.
Breach of these prohibitions will be an offence under the proposed regulations. A person found guilty of committing an offence under the regulations will be liable on summary conviction to a fine not exceeding level 5 on the standard scale, currently £5000; and upon conviction on indictment, to a term of imprisonment not exceeding 2 years or a fine or both. Local authorities will authorise persons to enforce provisions of these regulations. It is proposed that these regulations will come into force on 1 April 2025.
