TRANSPORT AND WORKS ACT 1992
The Secretary of State for Transport gives notice under section 14(1)(b), (2A) of the Transport and Works Act 1992 (“the Act”) that the Secretary of State has determined under section 13(1) of the Act to make with modifications the Network Rail Church Fenton Level Crossing Reduction Order 2023 (“the Order”).
The Order was applied for by Network Rail Infrastructure Limited, 1 Eversholt Street, London NW1 2DN. It will authorise Network Rail with powers to authorise works and purchase of land to mitigate the closure of three private rights vehicular access level crossings, known as Rose Lane, Poulters and Adamsons, located within an approximately 1km length of line commencing 300 metres south-west of Church Fenton station in the District of Selby. It would also authorise the closure of the three level crossings and provide new pedestrian and vehicular access routes for private rights holders across the railway. The Secretary of State has, pursuant to section 14(1)(a) of the Act, given notice of this by way of a decision letter dated 27 November 2023, copies of which may be obtained from the Transport Infrastructure Planning Unit, by emailing transportinfrastructure@dft.gov.uk. It can also be found on gov.uk at: Church Fenton level crossing reduction: Transport and Works Act order - GOV.UK (www.gov.uk) . That letter gives the reasons for the determination and the considerations upon which it is based; information about the public participation process; and information regarding the right to challenge the validity of the determination and the procedures for doing so.
