THE ISLINGTON (PRESCRIBED ROUTES) (NO. 15) EXPERIMENTAL TRAFFIC ORDER 2023
Notice is hereby given that the Council of the London Borough of Islington (‘the Council’), on 6 October 2023, has made the above-mentioned Orders under Sections 9, 10 and 124 and Part IV of Schedule 9 to of the Road Traffic Regulation Act 1984, as amended. 1. The general effect of the Orders would be to introduce a new experimental traffic management scheme on Balls Pond Road and Burder Road. The effect of this scheme will be to:
a) convert the existing shared-use parking bay on the east side of Burder Road into a loading bay;
b) extend the eastbound bus lane on the north side of Balls Pond Road between Kingsbury Road and Burder Road, westward to the eastern kerb-line of Kingsbury Road;
c) introduce a bus lane on the north side of Balls Pond Road between its junction with King Henry’s Walk and 14 metres west of the western end of the eastbound bus stop on Balls Pond Road (Culford Road stop BE); and
d) adjust the existing ‘no loading and no waiting between 7am-10am and 4pm-7pm Monday to Friday inclusive’ restrictions adjacent to the new and existing bus lanes on the north side of Balls Pond Road to apply instead between 7am-10am and 4pm-8pm Monday to Friday inclusive, at the following locations (existing ‘no waiting at any time’ restrictions will not be changed):
(i) between the eastern kerb-line of King Henry’s Walk and the western end of the eastbound Culford Road bus stop (stop BE); and
(ii) 3 metres east of the eastern kerb-line of Kingsbury Road and the western kerb-line of Kingsland Passage.
2. The Order provides that in pursuance of Section 10(2) of the Road Traffic Regulation Act 1984, the Director of Environment and Commercial Operations at the London Borough of Islington, or some person authorised by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Orders extends, modify or suspend any of the Orders or any provision thereof.
3. A copy of the Orders, which will come into force on 13 October 2023, and of other documents giving more detailed particulars are available for inspection. 4. The Council will be considering in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of permanent Orders made under sections 6, 45, 46 and 49 of the Road Traffic Regulation Act 1984. Any person may object to the making of the permanent Orders within a period of six months beginning with the day on which the experimental Orders come into force or, if the Orders are varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification comes into force. Any such objection must be in writing and must state the grounds on which it is made and be sent to Public Realm, 1 Cottage Road, London N7 8TP. Any objection may be communicated to, or be seen by, other persons who may be affected.
5. Any person who wishes to question the validity of the Orders, or of any provisions contained therein on the grounds that it or they are not within the relevant powers of the Road Traffic Regulation Act 1984 or that any requirement thereof or any relevant regulations made thereunder has not been complied with in relation to the Orders, may make application for the purpose to the High Court within six weeks from the date on which the Orders are made.
