THE LEWISHAM (PRESCRIBED ROUTES) (SCHOOL STREETS) (NO 11/21) TRAFFIC ORDER 2023

Made: 5th May 2023

Coming into force: 7th May 2023

The Council of the London Borough of Lewisham, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred the Road Traffic Regulation Act 1984(a), as amended, and all other powers thereunto enabling, hereby makes the following Order:-

Citation, commencement and expiry

1. This Order may be cited as The Lewisham (Prescribed Routes) (School Streets) (No. 11/21) Traffic Order 2023 (PTO1003), shall come into force on 7th May 2023.

Interpretation

2. (1) In this Order:-

"bus" has the same meaning as in Schedule 1 to the Traffic Signs Regulations and General Directions 2016(b);

"causing" includes permitting; "carriageway" has the same meaning as in section 329(1) of the Highways Act 1980(c);

"Council" means the Council of the London Borough of Lewisham;

this "Order" means The Lewisham (Prescribed Routes) (School Streets) (No 11/21) Traffic Order 2023

"disabled person's badge" and "disabled person's badge holder" have the same meaning as in Regulation 2 of the Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000(d);

"electronic communications network" has the same meaning as in section 32 of the Communications Act 2003(e);

"enactment" means any enactment, whether public general or local, and includes any order, byelaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment;

"motor vehicle" has the same meaning as in section 136(1) of the Road Traffic Regulation Act 1984;

"pedal cycle" has the same meaning as in Schedule 1 to the Traffic Signs Regulations and General Directions 2016(f);

"pedal cycle gap" means an area of a carriageway reserved as a route for pedal cycles only, segregated from the remainder of the carriageway by way of an island site, and indicated by way of a traffic sign of the type shown in Item 28 of Schedule 3, Part 2 to the Traffic Signs Regulation and General Directions 2016;

"pedestrian and cycle zone" has the same meaning as in Schedule 1 to the Traffic Signs Regulation and General Directions 2016;

"permit holder", in relation to a pedestrian and cycle zone referred to in an item in Schedule 1, means either:-

(a) a person who has satisfied the Council that their main place of residence is located at premises the postal address of which is specified in column (4) of that item, and in respect of whose vehicle a permit with a specific permit identifier displaying the letters and numbers specified in column (5) of the table to enter that pedestrian and cycle zone during the prescribed hours has been granted; or

(b) a person who has satisfied the Council that they are providing care to a resident at premises the postal address of which is specified in column (4) of that item, and in respect of whose vehicle a permit with a specific permit identifier displaying the letters and numbers specified in column (5) of the table to enter that pedestrian and cycle zone during the prescribed hours has been granted; or

(c) a disabled person's badge holder who has satisfied the Council that they are either a teacher or other school staff working at, or a parent of a pupil attending, or a carer providing care to a pupil attending a school located within that pedestrian and cycle zone, and in respect of whose vehicle a permit to enter that pedestrian and cycle zone during the prescribed hours has been granted;

(d) a person who has been granted a valid permit by the Council due to extenuating circumstances agreed by the Council's Head of Strategic Transport as defined in Article 6.

"permit identifier" has the same meaning as in Schedule 1 to the Traffic Signs Regulation and General Directions 2016;#

"prescribed hours" means, in respect of a pedestrian and cycle zone, the time periods specified in column (4) of the table in Schedule B in relation to that pedestrian and cycle zone;

"traffic sign" means a sign of any size, type and colour prescribed and authorised under, or having effect as though prescribed or authorised under section 64 of the Road Traffic Regulation Act 1984.

"valid permit" means a person to whom a valid permit has been issued under the provisions of this Order;

"Permit" in this Order means an electronic record of a "permit holder" issued and confirmed by the Council to exempt a vehicle from a restriction under the terms applicable at the time of issue.

(2) Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.

(3) Any reference in this Order to a numbered Article or Schedule shall, unless the context otherwise requires, be construed as a reference to the Article or Schedule bearing that number in this Order.

Prescribed routes

3. (1) No person, other than a permit holder, shall cause any motor vehicle to enter or proceed in a pedestrian and cycle zone referred to in the table in Schedule 1 during the prescribed hours.

(2) No person shall cause any motor vehicle to proceed in that part of Beacon Road in the London Borough of Lewisham which lies between the north-eastern kerb-line of Hither Green Lane and the western kerb-line of Ardmere Road in a direction other than from south-west to north-east.

(3) Except as provided in Article 4(3), no person causing any motor vehicle to proceed in a road or length of road referred to in column (2), shall cause that vehicle to enter the road or length of road specified in column (3) of Schedule 2.

Exemptions

4. (1) Nothing in Article 3 shall apply in relation to:-

(a) any vehicle being used for ambulance, fire brigade or police purposes.

(b) anything done with the permission or at the direction of a police constable in uniform or a civil enforcement officer; or

(2) Nothing in Article 3(1) shall apply to a bus entering a road or length of road specified in column (2) of Schedule 1

(3) Nothing in Article 3(2) or (3) shall apply to a pedal cycle entering a road or length of by way of a pedal cycle gap.

(4) Nothing in Article 3(1) shall apply in relation to:-

(a) a permit holder or with the written permission of the Council of the London Borough of Lewisham or its representative, provided that any conditions or requirements they may impose are being complied with; or

(b) any vehicle being used in connection with the removal of any obstruction to traffic in the street; the maintenance, improvement, reconstruction, cleansing or lighting within the street; the laying, erection, alteration in or adjacent to the street of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any electronic communications network or the placing, maintenance or removal of any traffic sign in the street, if the vehicle cannot be used for that purpose during the prescribed hours in any other road or length of road.

EXPLANATORY NOTE

(This Note is not part of the Order)

This Order:-

(i) forms part of a programme to introduce 'School Streets' (Pedestrian and Cycle Zones) in the roads in the vicinity of: Brindishe Green Primary School, Dalmain Primary School, Forster Park Primary School, Hatcham Temple Grove Free School, John Ball Primary School, Kender Primary School, Marvels Lane Primary School, Rathfern Primary School, St. Bartholomew's Primary School and St. William of York Catholic Primary School, during certain time periods at the beginning and end of the school day in the London Borough of Lewisham.

(ii) prohibits vehicles (other than pedal cycles using a signed pedal cycle gap) from entering into: that part of Beacon Road at its junction with Nightingale Grove, Faulkner Street at its junction with Briant Street and Pattenden Road at its junction with Galford Hill.

(iii) includes the removal of item 1 (relating to Beacon Road) in the Schedule in "The Lewisham (Prescribed Routes) (No. 4) Traffic Order 1985" which reinstates two-way traffic working for pedal cycles only in Beacon Road between its junctions with Hither Green Lane and Ardmere Road (that length remaining one-way north-eastbound for vehicles other than pedal cycles).
