NOTICE UNDER THE TRUSTEE ACT 1925
THE TPS BENEFITS SCHEME (THE “SCHEME”) – LIFE PLAN SECTION
T.P.S. BENEFITS SCHEME LIMITED (THE “TRUSTEE”)
Notice is hereby given pursuant to Section 27(1) of the Trustee Act 1925 that the Trustee of the Scheme is intending to commence the winding-up of the Life Plan section of the Scheme (which provided defined contribution/money purchase benefits only). All other current sections of the Scheme apart from the Life Plan section remain unchanged and will not be winding up as part of the Life Plan section winding-up.
The Life Plan section was created when the Scheme was established on 28 January 1999 under the name above.
Any former employee of TUV SUD (UK) Limited or any other participating employer within the Scheme (including but not limited to TUV Product Service Limited, TUV Suddeutschland (UK) Limited, TUV NEL Limited, TUV SUD Limited, TUV SUD Services (UK) Limited, TUV SUD Babt Unlimited, or British Approvals Board for Telecommunications), who believes that they were members of the Life Plan section of the Scheme and who is not receiving a pension arising from the Life Plan section of the Scheme should send particulars of his interest or claim in respect of the Life Plan section of the Scheme to the Trustee within the next two months from the date of this notice.
After this time, the Trustee will distribute all or any of the assets of the Life Plan section of the Scheme, to or among the persons entitled thereto, having regard only to the interests or claims of which the Trustee then has had notice. The Trustee shall not, then, be liable to any person of whose claim the Trustee or personal representatives have not had notice at or before the time of distribution.
Notification is not required from persons who are currently in receipt of a pension arising from the Life Plan section of the Scheme, or persons who have already received correspondence relating to the wind-up of the Life Plan section of the Scheme from the Trustee, or persons from all other current sections of the Scheme apart from the Life Plan section, which remain unchanged and will not be winding up as part of the Life Plan section winding-up.
Interested parties should write to the address below, and provide their full name, address, date of birth, National Insurance number, dates of membership of the Life Plan section of the Scheme, and any other information that forms the basis of their claim:
