BLACKPOOL BOROUGH COUNCIL (PLANNING LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (AS AMENDED)
DESIGNATION OF MARTON MOSS AREA
NOTICE IS HEREBY GIVEN that Blackpool Borough Council as local planning authority, in pursuance of powers under section 69 of the above Act, determined on 11th February 2019 following public consultation that the area described in the Schedule hereto is an area of special architectural or historic interest, the character or appearance of which it is desirable to preserve or enhance and has accordingly designated it as a conservation area to be known as Marton Moss Conservation Area.
The principle effects of the designation are as follows:
1. The Council is under a duty to formulate and publish proposals for the preservation or enhancement of the area.
2. Consent must be obtained from the Council for the demolition of any building in the area.
3. Special publicity must be given to planning applications for development in the area.
4. In carrying out any functions under the planning Acts (and in particular in determining applications for planning permission), the Council and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
5. It is an offence to cut down, lop, top or uproot a tree, subject to certain exceptions, within the area except with the non-objection of the local planning authority. Six weeks’ notice must be given to the Council before works are carried out to any tree in the area.
6. Permitted development rights under the Town and Country Planning (General Permitted Development) Order 1995 (as amended) are more restrictive than they are outside a conservation area
7. Specific statutory duties are imposed on telecommunications operators
8. Certain advertisements in the area will also be controlled by the local planning authority
