BLOCK TRANSFER OF INSOLVENCY CASES

Notice is hereby given that, by an Order of District Judge Carter in the High Court of Justice, Business and Property Courts of Manchester dated 28 March 2022, David Simon Matthew Edwards (IP number 8244) (‘the Applicant’) was removed as Office Holder in the cases listed in Schedule A below and Janette Louise Chillery-Belcher (IP number 22172) of Aaron & Partners LLP, 5-7 Grosvenor Court, Foregate Street, Chester, CH1 1HG (‘the Respondent”) was appointed as Office Holder in his place as specified below. All removals and replacement appointments were made with immediate effect.

Notification

The Applicant David Simon Matthew Edwards be removed from office in respect of each of the cases listed in Parts 1, 2 and 3 of Schedule A (attached to this order) (block transfer cases) from the date of this order;

The Respondent Janette Louise Chillery-Belcher be appointed as replacement office-holder in respect of each of the block transfer cases listed in Parts 2 and 3 of Schedule A from the date of this order;

The creditors in each of the block transfer cases listed in Schedule A be notified of this order by the Applicant or the Respondent placing notice of it within the London Gazette within 28 days of the date of this Order;

Any creditor in respect of any of the companies or persons listed in Schedule A who has an objection to this order shall have 21 days from the date of the advertisement to apply to court to set aside or vary the terms of this order. Such application shall not affect the transfer of the block transfer cases listed in Schedule A until further or other order by the court;

The Respondent shall file any appropriate notices in respect of the removal of the Applicant and the appointment of her as replacement officeholder with the Secretary of State for Business, Energy & Industrial Strategy (Insolvency Service) and the Registrar of Companies as may be required;

The Applicant shall file a copy of this order with each of the courts listed in Schedule A;

Nothing in this order shall release the Applicant from any obligation to give and file notices in respect of his removal under this order in respect of the block transfer cases listed in Schedule A;

The Applicant David Simon Matthew Edwards shall be at liberty to apply to the Secretary of State for his release:

a) as voluntary liquidator pursuant to section 173(2)(b)(ii) of the Insolvency Act 1986;

b) as compulsory liquidator pursuant to section 174(4)(b)(ii) of the Insolvency Act 1986; and

c) as Trustee in Bankruptcy pursuant to section 299(3)(b)(ii) of the Insolvency Act 1986

14 days after the giving of notice to creditors in accordance with this order, save that such release may be subject to further order in the event of an application by any creditor under paragraph 8 of this order for the specific case subject to that application.
