NOTICE UNDER SECTION 27(1) OF THE TRUSTEE ACT 1925

THE PENSION AND LIFE ASSURANCE PLAN OF WACHOVIA BANK, NATIONAL ASSOCIATION (“THE PLAN”)

Formerly known from time to time as The Pension and Life Assurance Plan of First Union National Bank, The Pension and Life Assurance Plan of First Fidelity Bank and The Pension and Life Assurance Plan of The Fidelity Bank, including former members of the CoreStates Bank, NA Pension Scheme (formerly known as the Philadelphia National Pension Scheme).

Notice is hereby given, pursuant to Section 27 of the Trustee Act 1925, that any person who believes that they have a claim against, or entitlement to a pension or any benefit from The Pension and Life Assurance Plan of Wachovia Bank, National Association (or any of the former schemes listed above) is hereby required to send particulars in writing within two months of the date of this notice of their claim or entitlement (together with full name, present address and date of birth) to the Trustee of the Plan, c/o Wachovia Plan Admin Team, Lane Clark & Peacock LLP, 95 Wigmore Street, London, W1U 1DQ marked for the attention of Jo Franklin.

The Trustee is winding up the Plan and will distribute any assets of the Plan among the persons entitled thereto having regard only to those persons whose claims and entitlements they have notice, and will not be liable to any other person. Any individuals who have previously been contacted on behalf of the Trustee about this matter should not respond to this notice as the Trustee already has details of their claims and entitlements.
