HIGH SPEED RAIL (CREWE - MANCHESTER) BILL

NOTICE IS HEREBY GIVEN that the Secretary of State for Transport has introduced in the present Session of Parliament a Bill under the above name or short title for purposes of which the following is a concise summary:–

1. The provision of a railway between a junction with Phase 2a of High Speed 2 south of Crewe in Cheshire and Manchester Piccadilly Station, and between Hoo Green in Cheshire and a junction with the West Coast Main Line at Bamfurlong, south of Wigan, other railway works in connection with those railways or High Speed 2 including works at Preston and Carlisle stations and a railway depot off the West Coast Main Line in Dumfries and Galloway, works for the relocation and construction of tramways and tramroads in the vicinity of Manchester Piccadilly station, and for connected purposes.

2. Provision to authorise the nominated undertaker to construct and maintain works, a general description of the nature of which is set out in Schedule 1 to this notice, and to authorise the nominated undertaker to compulsorily acquire or use land in the districts and parishes mentioned in Schedule 1 or Schedule 2 to this notice.

3. In connection with the tramways referred to in paragraph 1 and generally described in Schedule 1 to this notice, sheet no. 2-24 of the deposited plans accompanying the Bill indicates (by a thick dotted line) at what point, and on which side of the street or road, it is proposed to lay the tramway so that for a distance of 10 metres or upwards, a lesser space than 3 metres will intervene between the outside of the footpath on either side of the street or road, and the nearest rail of the tramway.

4. In connection with the construction of the tramways and tramroads referred to in paragraph 1 and generally described in Schedule 1 to this notice, the gauge to be adopted is 1,435 millimetres and the motive power to be employed is electrical energy, or in emergency or for maintenance, diesel power or other means.

5. Powers for the nominated undertaker to carry out subsidiary works; to carry out landscaping and other works to mitigate adverse effects of the authorised works or for the benefit or protection of land; to undertake diversions of specified overhead electric lines crossing the intended route; to survey or investigate land and protect flora or fauna and provision for the application and modification of certain provisions of Part 7 of the Housing and Planning Act 2016 relating to entry onto land in connection with those powers; the supporting or strengthening of buildings, or the replacement, supporting or strengthening of apparatus, within 50 metres of any work or 100 metres where the work relates to a shaft, including power to survey buildings and to enter on adjoining property; power to require, or to enter land to carry out, tree works where trees overhang land used for the railway or tree roots encroach on such land; power to carry out noise mitigation works to buildings; power to discharge water into watercourses or public sewers or drains; temporary interference with specified waterways in connection with the authorised works, including powers to moor barges or other vessels and temporarily to close such waterways to navigation subject to restrictions; the provision of additional capacity for electronic communications apparatus installed under the intended Act; power to lay out or improve means of access at locations shown on the deposited plans and, subject to restrictions, at other locations within the limits of deviation or the limits of land to be acquired or used shown on those plans (“the intended Act limits”) and provision making it an offence for a person to obstruct the construction of the works authorised by the Bill and works authorised by the High Speed Rail (London – West Midlands) Act 2017 and the High Speed Rail (West Midlands - Crewe) Act 2021.

6. Provision to authorise interference with, or obstruction of, highways, including power for the nominated undertaker to stop up specified highways or parts of highways; powers for Ministers to authorise the stopping up of footpaths or bridleways within the intended Act limits on being satisfied as to the provision of alternative footpaths or bridleways; provision for the creation of public rights of way over specified footpaths and bridleways provided under the Bill; powers for the temporary stopping up, alteration or diversion of highways and other interference with highways for the purposes of constructing the authorised works, including powers to break up all or part of the surface of highways for those purposes (which include breaking up highways in order to place and maintain apparatus) and to use a stopped up highway as a working site; powers to place and maintain apparatus in highways and application of provisions of Part 3 of the New Roads and Street Works Act 1991 relating to major transport works; provision relating to highways which are constructed or altered including the maintenance period for such highways, liability for maintenance and application of sections 116 and 117 of the Transport Act 1968.

7. In connection with the construction and maintenance of the tramways and tramroads referred to in paragraph 1 and generally described in Schedule 1 to this notice, additional powers in relation to those works including power to carry out subsidiary works associated with tram works including stations, platforms and tram stops and works for the control of traffic on the authorised transit system; landscaping and mitigation works; powers in relation to the laying down of rail lines and the construction of street tramways and tramroads regardless of their description; power to alter the layout of streets and to carry out street works; provision for the restoration of streets in the event of the discontinuance of a tramway; provision in relation to the construction of level crossings; power to attach apparatus to buildings; provision in relation to the mode of construction and operation of the authorised transit system; provision for the application of existing enactments; provision for the placing of traffic signs; provision relating to traffic regulation; power to transfer rights to construct and operate the works and provision for the disapplication of other railway legislation.

8. In connection with the construction of the works specified in Schedule 1 to this notice and paragraph 3 above, provision for the stopping up or diversion of the public footpaths and bridleways specified in Schedule 3 to this notice.

9. In connection with the construction of any tramway or underground railway specified in Schedule 1 to this notice, provision for the alteration or disturbance of the surface of the roads or streets specified in Schedule 4 to this notice.

10. Powers for the compulsory acquisition of lands by the Secretary of State within the intended Act limits in the areas referred to in paragraph 2 above and Schedules 1 and 2 to this notice, including powers for the acquisition of lands within the limits of land to be acquired or used shown on the deposited plans for specified and other purposes; the application, subject to modifications, of Part I of the Compulsory Purchase Act 1965, the Compulsory Purchase (Vesting Declarations) Act 1981 and other compulsory purchase legislation; provision as to the compulsory acquisition of rights in land, including the creation of new rights and the imposition of restrictive covenants and power for the Secretary of State by order to enable rights or restrictive covenants to be acquired or imposed under the Act by specified persons; powers to acquire only the airspace or subsoil of lands and, in specified cases, the restriction of powers of acquisition to only subsoil (being specified land lying either more than 9 metres, 7.5 metres, 6 metres or 4.5 metres below the surface of the ground); powers to appropriate or acquire highway subsoil; provision requiring the powers of compulsory acquisition of land to be exercised within 8 years and for the extension of that period (by order, for a maximum of an additional 2 years, exercisable only once in relation to any particular land) subject to the right of an owner or lessee with over 21 years to require his interest to be acquired; provision as to the extinction of private and general rights (including public rights of access) over land within the intended Act limits and special provision as to the extinction of rights of statutory undertakers; provision to exclude the acquisition of rights of way by prescription or user over certain land; provision for the nominated undertaker to take temporary possession of and use land within the intended Act limits and to use specified roads temporarily; provision as to the enforcement of restrictions on land use.

11. The lands which may be acquired or used include the common land, park and open space set out in Schedule 5 to this notice and the canal tow paths and related land set out in Schedule 6 to this notice.

12. Disapplication of the Planning Act 2008 in relation to the works authorised by the Bill; provision as to the grant of deemed planning permission for development authorised by the intended Act which is begun within 10 years from its passing or such longer period as may be specified in an order made by the Secretary of State, and the reservation of specified matters for determination by the planning authority; the making of regulations by the Secretary of State specifying local planning authorities qualifying for extended powers in relation to development so authorised; planning conditions requiring approval of specified matters by non-qualifying authorities or approval of those and other specified matters by qualifying authorities; Provision as to the disapplication or modification of provisions of the Planning (Listed Buildings and Conservation Areas) Act 1990 including disapplication or modification in relation to specified buildings and structures which may be altered or demolished and provision as to the disapplication or modification of provisions of the Ancient Monuments and Archaeological Areas Act 1979 and the National Heritage Act 1983 in the case of works or operations carried out in pursuance of the intended Act.

13. Disapplication of enactments and other law relating to burial grounds and provision relating to the removal of remains and monuments; disapplication of section 37 of the Electricity Act 1989 and the Planning Act 2008 in relation to overhead lines; determination of appeals under sections 60 and 61 of the Control of Pollution Act 1974 and limitation on proceedings in respect of nuisance under section 82 of the Environmental Protection Act 1990.

14. Disapplication or modification of statutory or other controls, including obligations or restrictions relating to consecrated land, enactments relating to commons, town or village greens, open spaces or allotments; tree preservation orders and similar prohibitions in conservation areas; sections 24, 25 and 48A of the Water Resources Act 1991; Regulation 12 of the Environmental Permitting Regulations 2016; Section 3(1)and (2) of the Crown Estate Act 1961 (limitations on Crown Estate Commissioners’ powers of disposal in relation to land under their management); paragraph 5 of Schedule 1 and paragraph 7 of Schedule 3 to the Flood and Water Management Act 2010 and Part 4 of the Eels (England and Wales) Regulations 2009; Part 1 and sections 61, 62, 73 and 74 of the Building Act 1984; the Party Wall etc. Act 1996; sections 141, 167 and 169 of the Highways Act 1980; sections 56, 56A, 58, 61, 62, 63, 73A, 74A, 78A of, and Schedule 3A to, the New Roads and Street Works Act 1991; Part 3 of the Traffic Management Act 2004; orders under section 1, 9 or 14 of the Road Traffic Regulation Act 1984 restricting heavy commercial vehicles; section 12 of the Cheshire County Council Act 1968; section 12, Part 8 and sections 48, 50 and 57 of the Cheshire County Council Act 1980; sections 26, 27(1)(b), 34, 38, 63 and Part 8 of the Greater Manchester Act 1981; provision disapplying liability to Community Infrastructure Levy under Part 11 of the Planning Act 2008 in relation to development authorised by the Bill.

15. Modifications of the functions of the Office of Rail and Road in relation to the railway; disapplication of the licensing regime under section 6 of the Railways Act 1993 in relation to the pre-operational phase of the railway and of provisions of the Railways Act 2005 concerning closure of services arising from the construction or operation of the railway; duty of controllers of railway facilities to co-operate in matters affecting the railway and any such facility not comprised in it, and the determination by arbitration of agreements between such operators and the nominated undertaker; powers for the Secretary of State to transfer statutory functions relating to works on acquired railway land.

16. Provision relating to the making, variation and revocation of orders made under section 1, 9 or 14 of the Road Traffic Regulation Act 1984 and as to the removal of vehicles from roads in contravention of a traffic regulation order or stopped up under the powers of the Bill; the making of regulations appointing nominated undertakers for the purposes of specified provisions of the intended Act, the extension of provisions relating to permitted development to certain works carried out by statutory undertakers; provisions protecting the interests of specified bodies and persons potentially affected by the intended Act; power for the Secretary of State to make compulsory purchase orders to acquire land for the relocation of displaced undertakings; provision for the application to the Bill of certain agreements relating to the High Speed Rail (London – West Midlands) Act 2017; provision with respect to works carried out by the nominated undertaker for the reinstatement of discontinued or substantially impaired businesses or facilities; provision relating to the enforcement of environmental covenants; modification of the definition of EIA development in the Town and Country Planning (Environmental Impact Assessment) Regulations 2017 in respect of buildings constructed in place of buildings demolished under the powers of the Bill and power for transport and works orders relating to the authorised works or an extension of the railway to apply certain provisions of the intended Act.

17. Miscellaneous and general provisions, including the incorporation of provisions of the Railway Clauses Consolidation Act 1845, provisions relating to the Railways Regulation Acts, increase of penalties under specified provisions of those Acts and the extension to the railway of sections 55 and 56 of the British Transport Commission Act 1949 concerning trespass on railways and throwing of missiles, provision for the resumption of planning permission relating to land on the discontinuance of its development; the application of powers of the Bill in relation to crown Land with consent of the relevant Crown authority; and provision relating to arbitration and the service of notices.

18. Provision relating to the application of the provisions of the Bill in relation to land and works in Scotland so as to substitute references to relevant Scottish legislation for references to English legislation.
