THE KENSINGTON AND CHELSEA (CHARGED-FOR PARKING PLACES) (AMENDMENT NO. 21) EXPERIMENTAL TRAFFIC ORDER 2021

1. NOTICE IS HEREBY GIVEN that the Council of the Royal Borough of Kensington and Chelsea on 8th January 2021 made the above-mentioned Orders under sections 9 and 10 of the Road Traffic Regulation Act 1984, as amended. The Orders will come into force on 25th January 2021 and continue in force for up to 18 months.

2. The general effect of the Orders will be on an experimental basis to:

(a) prevent all motor vehicles, other than motorcycles, from entering the length of Elystan Street that lies between the south-eastern kerb-line of Whitehead’s Grove and the north-western kerb-line of Elystan Place;

(b) suspend the permit parking place on the north-east side of Elystan Street, in the length of street specified in paragraph (a) above;

(c) provide ‘at any time’ waiting restrictions in Elystan Street: (i) the north-east side, between the south-eastern kerb-line of Whitehead’s Grove and the northern kerb-line of Elystan Place; and (ii) the south-west side: (A) between the south-eastern kerb-line of Whitehead’s Grove and a point 3.5 metres south-east of that kerb-line; and (B) between the northern kerb-line of Elystan Place and a point 6 metres north-west of that kerb-line.

Note: [In the part of Elystan Street specified in paragraph (a) above: The one-way system will continue to apply to motorcycles, access to the cycle hire docking station and the visitor motorcycle bay will be maintained and access for Emergency vehicles and the Council’s waste collection and cleaning vehicles will also be maintained.]

3. The Orders provide that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Director for Streets and Regulatory Services at the Council of the Royal Borough of Kensington and Chelsea, or some person authorised by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Orders extends, modify or suspend the Orders or any provision thereof.

6. The Council will be considering in due course whether the provisions of the Orders should be continued indefinitely by means of Orders made under section 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of these Orders for the purpose of such indefinite continuation within a period of six months beginning with the day on which the Orders come into force, or, if any of the Orders are varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force. Any such objection must be in writing and must state the grounds on which it is made and be sent to Traffic Orders, Room 308, Council Offices, The Royal Borough of Kensington and Chelsea, 37 Pembroke Road, London, W8 6PW or email: trafficorders@rbkc.gov.uk, quoting reference RBKC/TMO/Elystan Street ETO by 25th July 2021.

7. Under the Local Government (Access to Information) Act 1985, any letter you write in response to this Notice may be made available to the press and to the public, who would be entitled to take copies of it if they so wished.

8. Anyone wishing to question the validity of the Orders or of any of their provisions on the grounds that they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or of any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Orders were made, apply for the purpose to the High Court.
