NOTICE UNDER REGULATION 27
The proposed development at Sneddon Law windfarm, off Hemphill Road, Moscow, East Ayrshire is subject to environmental impact assessment under the Town and Country Planning (Environmental Impact Assessment) (Scotland) Regulations 2017.
Notice is hereby given that additional information in relation to an EIA report has been submitted to East Ayrshire Council by Community Windpower Limited relating to an application under Section 42 of the Town and Country Planning (Scotland) Act 1997 (as amended) to vary conditions 37, 41, 42 and 43 of Planning Permission 13/0198/ PP together with the supplemental conditions imposed pursuant to the discharge of condition 15 of the same permission on appeal under reference PPA-190-2053 (Construction Environmental Management Plan) and the supplemental conditions imposed pursuant to the discharge of condition 36 of the same permission on appeal under reference PPA-190-2054 (Private Water Supplies)
Note that this application was previously described as “An application under Section 42 of the Town and Country Planning (Scotland) Act 1997 (as amended) to develop land without compliance with conditions previously attached to planning permission 13/0198/PP comprising variations to planning conditions 15 (Construction Environmental Management Plan), 36 (Water Risk Assessment) and 37 (Traffic Management Plan) and to remove conditions 41 (Borrow Pits), 42 (Times of Blasting) and 43 (Scheme of Blasting) of that planning permission”.
A copy of the additional information together with the EIA report, the associated application and other documents submitted with the application, would normally be available for public inspection in person. In line with the Town and Country Planning (Miscellaneous Temporary Modifications) (Coronavirus) (Scotland) Regulations 2020, the additional information and other information in support of the application is only available to view online at https://eplanning.east-ayrshire.gov.uk/online/ (using reference 20/0070/PP).
Any person who wishes to make representations to East Ayrshire Council about the additional information should make them in writing to the Council within 30 days beginning with the date of this notice and submit them (i), by e-mail to submittoplanning@east-ayrshire.gov.uk (ii) online at https://eplanning.east-ayrshire.gov.uk/online/ or (iii) by post to The Opera House, 8 John Finnie Street, Kilmarnock, KA1 1DD. Representations should quote reference 20/0070PP.
Copies of the additional information may be purchased from Community Windpower Limited, Godscroft House, Godscroft Lane, Frodsham, WA6 6XU at a cost of £100 for a hard copy of the EIA Addendum or £15 for an electronic copy and £150 for a hard copy of the Transport Assessment and £15 for an electronic copy.
Should additional environmental information be submitted by the applicant, that information will be publicised by East Ayrshire Council under Regulation 27 of the above Regulations and in a similar manner to the notification given under this notice. Any such publication will include details of how representations in relation to that additional information may be made.
Possible decisions that could be taken by East Ayrshire Council in its role as Planning Authority for the area and relating to this application are:—
(i) Approval of the application without conditions;
(ii) Approval of the application with conditions differing from those subject to which the previous permission was granted;
(iii) Refusal of the application.
