IN THE MATTER OF SECTION 63(1) OF THE TRUSTEE ACT 1925 (AS AMENDED)

Anglo American plc, whose registered office is at 20 Carlton House Terrace, London, SW1Y 5AN, and registered in England under number 03564138 (the “company”).

Security Nominees Limited, whose registered office is at 20 Carlton House Terrace, London, SW1Y 5AN, and registered in England under number 00236669 (the “trustee”).

Notice is hereby given to the holders of Anglo American Corporation of South Africa Limited (AAC) Share Warrants to Bearer (issued 5th December 1969), who have yet to surrender their Share Warrants and for whom consideration resulting from the company’s acquisition of AAC in May 1999, by Scheme of Arrangement in terms of Section 311 of the South African Companies Act 1973, was allotted to and continues to be held by the trustee since the effective date of the scheme, 24 May 1999.

The trustee has been under obligation to hold unclaimed scheme consideration, and collect, record and administer all dividends, capital payments and secondary share balances resulting from subsequent corporate activity. This administration is currently outsourced to the company’s share registrar and transfer agent, Equiniti Limited (“Equiniti”), a company registered in England under number 06226088.

The trustee confirms its intention to terminate the current arrangement after the expiry of 60 days from the date of this notice whereupon it shall proceed with an application to the High Court of Justice Chancery Division, pursuant to section 63(1) of the Trustee Act 1925 (as amended), for payment of the unclaimed monies into Court.

Holders of AAC Share Warrants to Bearer should contact Equiniti Limited, Aspect House, Spencer Road, Lancing, BN99 6DA. Stating their full name, address and enclosing their original Warrant Certificates in respect of the Share Warrants to Bearer held. Note - Equiniti will not accept any form of indemnity in respect of a lost, damaged or destroyed Warrant Certificate and reserves the right to require applicants to complete further identity checks in respect of any application it may receive.
