PUBLIC NOTICE

Notice is hereby given that on the 9th of December 2019 Westminster City Council made The City of Westminster (Stopping Up of Highways) (No.8) Order 2019 under sub-section 247 (2A) of the Town and Country Planning Act 1990 (“the 1990 Act”), the general effect of which is to authorise the stopping up of a 182.2 square metres area of the highway Shaftesbury Avenue and a 38.3 square metres area of the highway Denman Street to enable development to be carried out at the building 1-23 Shaftesbury Avenue, London, W1D 7EA (“the Building”); that involves the repositioning of the ground floor external wall of that building.

The part of the highway that the order authorises to be stopped up

(a) extends in a direction that is perpendicular to the middle line of Shaftesbury Avenue by a distance of between zero and 5 metres from the present south-west most length of the ground floor external wall of the Building across the adjacent 3.76 metres length of the highway Shaftesbury Avenue;

(b) extends by a distance of between 4.91 metres and zero metres from the present north-east most 2.98 metres length of the ground floor external wall of the Building in a direction that is perpendicular to the middle line of Shaftesbury Avenue;

(c) extends in a direction that is perpendicular to the middle line of Shaftesbury Avenue by a distance of between 5 metres and 4.91 metres from the present 33.9 metres length of the ground floor external wall of the Building that intervenes between the lengths of the Building described in paragraphs (b) and (a) above;

(d) extends in a direction that is perpendicular to the middle line of Denman Street by a distance of 0.45 metres from the southern boundary of Denman Street across the present east most 2.27 metres length of Denman Street,

(e) extends in a direction that is perpendicular to the middle line of Denman Street by a distance of 1.2 metres from the southern boundary of the length of the highway Denman Street situated between 2.27 metres and 33.33 metres from its common boundary with Shaftesbury Avenue, and

(f) lies adjacent to the Building.

The order and plan identifying the location of the highway authorised to be stopped up may be inspected free of charge between 11am and 5pm Mondays to Fridays at Westminster City Hall, 64 Victoria Street, London, SW1E 6QP, during a period of 42 days from the date of this notice. Any person aggrieved by the order who desires to question the order’s validity may make an application to the High Court under section 287 of the Town and Country Planning Act 1990 Act within six weeks of the date this notice is first published
