HARBOURS ACT 1964 (AS AMENDED)
THE PROPOSED HOLYHEAD HARBOUR REVISION ORDER
NOTICE OF APPLICATION FOR A HARBOUR REVISION ORDER
1. NOTICE IS HEREBY GIVEN THAT Stena Line Ports Limited (“Stena”) has applied to the Welsh Ministers for a Harbour Revision Order under section 14 of the Harbours Act 1964 ("the 1964 Act").
2. The proposed Order would authorise Stena to construct and maintain works at Holyhead harbour in the County of Anglesey. The works comprise the reclamation of two areas of land within the harbour together with associated works including a wave wall, an area of rock armour revetment and two single storey warehouse buildings. The Order would also authorise the construction of subsidiary works and confers powers to dredge for the purposes of constructing and maintaining the works.
3. In addition, the proposed Order would confer powers in relation to the issuing of general and special directions within Holyhead harbour and the approaches to it in the interests of securing the safety of navigation and compliance with the Port Marine Safety Code.
4. Prior to the transfer to Welsh Ministers of functions relating to Harbour Revision Orders on 1 April 2018-
a) notification of the intended application was given to the Marine Management Organisation on 28 April 2017 under paragraph 3(a) of Schedule 3 to the 1964 Act,
b) the Marine Management Organisation decided in accordance with paragraph 4 of Schedule 3 to the 1964 Act that the application relates to a project which falls within Annex I to Council Directive 2011/92/EU (as amended) on the assessment of the effects of certain public and private projects on the environment (“the Directive”) specifically, paragraph 8(b) of that Annex as set out below –
“8(b) Trading ports, piers for loading and unloading connected to land and outside ports (excluding ferry piers) which can take vessels of over 1350 tonnes”.
5. Accordingly, an environmental assessment is required and Stena has supplied the Welsh Ministers with an Environmental Statement.
6. Copies of the draft Order, the decision of the Marine Management Organisation referred to in paragraph 4(b) above, the Environmental Statement and the plans, sections and elevations which accompanied the application may be inspected free of charge at all reasonable hours at Holyhead Town Hall, Newry Street, Holyhead LL65 1HN until the expiry of the forty-two day period specified below. Copies of the Environmental Statement may be obtained from Stena at Technical Services Department, Stena House, Station Approach, Holyhead, Anglesey LL65 1DQ (telephone: 01407 606690) at a charge of £100 for a hard copy and £5 on USB stick.
7. The draft Order and accompanying information may also be viewed on the Welsh Ministers’ website at https://gov.wales/ports-harbours.
8. Paragraph 16 of Schedule 3 to the Harbours Act 1964 (which relates to information on a project which is likely to have significant effects on the environment in any other European Economic Area Member State) does not apply to the application.
9. Any person wishing to make an objection or representation to the Welsh Ministers concerning the application should write to The Planning Inspectorate, Crown Buildings, Cathays Park, Cardiff, CF10 3NQ or email wales@planninginspectorate.gov.uk.
10. An objection or representation should:
i. be received before the expiry of the period of 42 days starting with the date at the foot of this notice;
ii. be made in writing quoting reference 3234821;
iii. state the grounds of the objection or representation;
iv. indicate who is making the objection or representation; and
v. give an address to which correspondence relating to the objection or representation may be sent.
11. Any objection or representation received by the Welsh Ministers cannot be treated as confidential and will be passed to Stena as well as be made publicly available online. Objections and representations should refrain from including personal or sensitive information.
12. The Welsh Ministers will pass to Stena a copy of any objection and other representations received.
13. If an objection is duly made to the application and not withdrawn the Welsh Ministers may cause an inquiry to be held. Any objections duly made and not withdrawn and any representations duly made will be considered before the Welsh Ministers make a determination in respect of the application.
