Notices under the Trustee Act 1925
NOTICE UNDER SECTION 27 OF THE TRUSTEE ACT 1925
THE RWE NPOWER GROUP OF THE ELECTRICITY SUPPLY PENSION SCHEME
Notice is hereby given pursuant to section 27 of the Trustee Act 1925 that the Group Trustees of the RWE npower Group (the "Group") of the Electricity Supply Pension Scheme (the "ESPS") are winding up the Group.
The Group is part of the ESPS. The ESPS is a sector-wide pension scheme established in 1983. Following the privatisation of the electricity industry in 1990, the ESPS was split up into a number of different groups corresponding to the newly created Regional Electricity Companies and Generators. The Group is one of those groups.
Following a restructuring of RWE in 2016:
• the benefits of certain members and beneficiaries of the Group were transferred to two new groups of the ESPS, namely the RWE npower (No 2) Group in respect of the Generation business and the RWE npower (No 3) Group in respect of the Innogy business; and
• the Principal Employer and the Group Trustees of the Group (the “No 1 Group”) wish the No 1 Group to be wound up in accordance with the rules of the ESPS.
The Group Trustees have written to all members and beneficiaries currently receiving benefits, or with a known entitlement to present or future benefits under the No 1 Group.
If you have not recently been contacted but believe you have an entitlement to any benefit from, or interest in, the No 1 Group, by reason of your own, a relative's or any other person's full or part time employment with any current or previous employer participating in the No 1 Group, you are required to send particulars in writing by 28 February 2018 of your entitlement or interest (together with your full name, present address, date of birth and copies of all documents which support your claim) to Louise Coxon, Pinsent Masons Pension Services, 55 Colmore Row, Birmingham B3 2FG.
After the expiry of this notice on 28 February 2018, the No 1 Group will be wound up in accordance with the rules of the ESPS. Benefits will only be provided to those persons whose valid claims and entitlements the Group Trustees have received notice of by 28 February 2018 and they will not be liable to or in respect of any other person.
Any individuals who have already been contacted by the Group Trustees about their benefits under the No 1 Group (as stated above) should not respond to this notice, as the Group Trustees will already have details of their claims and entitlements (if any). Similarly, you should not respond to this notice if you were formerly a member or beneficiary of the Group and have been notified that your benefits have been transferred to the RWE npower (No 2) Group or the RWE npower (No 3) Group of the ESPS (as stated above).
