DESIGNATION OF ROTHERFIELD CONSERVATION AREA
NOTICE IS HEREBY GIVEN THAT Wealden District Council (hereinafter called “the Council”), in pursuance of its powers under section 69 of the Planning (Listed Buildings and Conservation Areas) Act 1990, has reviewed the ROTHERFIELD Conservation Area previously designated in 1997. The review considered whether the area remained of special architectural or historic interest and that it is desirable to preserve or enhance its character or appearance. The review concluded that a conservation area should be designated in ROTHERFIELD, with amendments to the previously designated area, to show additional areas included. All properties previously within the designated conservation area and not listed below remain within the conservation area designated as of 22 March 2017. Public consultation took place in parallel with the Issues and Options Consultation on the Wealden Local Plan in 2015 and the Council has had regard to any written representations made when resolving to designate the conservation area in the amended form.
The additional areas described in SCHEDULE ONE were designated as part of the ROTHERFIELD Conservation Area on 22 March 2017.

The principal effects of this designation are as follows:
• In carrying out any function under the planning acts (and in particular for determining applications for planning permission) the Council and the Secretary of State are required to take into account the desirability of preserving and enhancing the character and appearance of the area.
• Special publicity must be given to planning applications for development in the conservation area.
• Planning permission is required for the demolition or substantial demolition of a building within a conservation area, and may be needed for the demolition of gates, fences, walls and railings. It is now a criminal offence to carry out demolition in a conservation area without planning permission.
• The Council must usually be notified in advance if works are proposed to any trees within a conservation area. Once notice has been given, no works can commence until either six weeks have elapsed or the Local Planning Authority has granted consent. Carrying out works without fulfilling this requirement is an offence;
• Certain householder permitted development rights are reduced or removed, and permission may be needed from the Council before making alterations such as cladding, inserting windows, installing satellite dishes and solar panels, adding conservatories or other extensions, laying paving or building walls. The Council can add to the types of alterations that need planning permission by making an Article 4 Direction and this can be used to protect features particular to the area from being lost without the need of permission.
• The Council is under a duty to formulate and publish plans to ensure the preservation or enhancement of the Conservation Area.
