NOTICE FOLLOWING BLOCK TRANSER ORDER

Notice is hereby given pursuant to the order of District Judge Obodai in the High Court of Justice, Chancery Division, Manchester District Registry, Case Number 2340 of 2016 dated 6 April 2016 (“the Order)

That Francesca Tackie (“the First Respondent”) shall, with immediate effect, be removed from office as Liquidator, Administrator or Supervisor of the estates listed in the following schedules and be replaced by such office holder or jointly by such office holder (the replacement officeholder), named in the following schedules:

In the cases where The First Respondent is replaced as Joint Administrator, the office holder replacing her in each case shall additionally replace her as the nominated joint Liquidator under the terms of the Administrators’ proposals for the purposes of placing the Company into creditors’ voluntary liquidation.

The removal and appointments granted by the Order shall not disturb the existing reporting cycle for each of the respective insolvency appointments listed in the Schedules and the current time limit for reporting to creditors on each of the insolvency appointments shall continue irrespective of the removal and appointments made in the Order.

The provisions contained in Insolvency Rules 2.47(3)(A) and, 4.49(B)(5) and 4.49C- CVL(3) of the Insolvency Rules 1986 or any other such reporting requirements shall not apply and the First Respondent is not required to produce any progress reports on ceasing to act as officeholders of the insolvency appointments listed in the Schedules.

The First Respondent shall be granted her release as appropriate 21 days after the publication of this notice in the London Gazette.

The Applicants be entitled to publish in the London Gazette one composite notice relating to all new appointments which are required by law to be published in the Gazette within 14 days of receipt of the sealed Order and shall file any appropriate notices in respect of the removal of the First Respondent, the appointment of replacement office holders and those appointments with the Registrar of Companies and the Secretary of State for Business Innovation and Skills (Insolvency Services) as appropriate.

Notice of the Order shall also be given to the creditors in each case in the next statutory report for each insolvency administration listed in the Schedules.

The costs of placing notice of this Order in the London Gazette (but not the costs of the Application) be aggregated and be drawn as a proper expense of each of the cases listed in the Schedules which shall each bear an equal proportion of such costs and disbursements where sufficient funds are available, save that an expense borne by a Company Voluntary Arrangement that would cause it to fail as a result of a breach of its terms shall not be subject to such apportionment.

If in any of the cases listed in the Schedules there are insufficient funds to bear that case’s ostensible share of the cost of placing Notice in the London Gazette, the Applicants may apportion that case’s share of the costs among the other cases listed in the Schedules in their discretion.

Liberty to each creditor of each estate to apply to vary or discharge this Order within 21 days of the date of the publication of this notice in the Gazette.

Service of the Notice of the Application be dispensed with.
