THE NEWHAM (MARKET STREET) (WAITING AND LOADING RESTRICTION) (NO. 3) EXPERIMENTAL TRAFFIC ORDER 2015
1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Newham on 21 September 2015 made the above-mentioned Orders under Section 9 of the Road Traffic Regulation Act 1984, as amended.
2. The general effect of the Orders will be to further extend the existing Market Street Controlled Parking Zone (CPZ) into the uncontrolled part of Pulleyns Avenue (between Basil Avenue and Sandford Road). The restrictions in the new CPZ extension will include:
• Parking places for permit holders only operating from 8am to 6.30pm on Monday to Saturday.
• Waiting restrictions operating ‘at any time’ at the junction of Pulleyns Avenue and Basil Avenue.
• A disabled resident parking place, operating at any time, for use by disabled badge holders who meet the current criteria for provision of disabled persons’ parking places outside No. 74 Pulleys Avenue.
• Residents and businesses whose main address falls within the currently uncontrolled part of Pulleyns Avenue will be eligible for permits.
3. The annual fee for a resident parking permit will be free for the first vehicle in a household, £100 for the second vehicle and £200 for a third vehicle or more. The fee for a business parking permit will be £175 for 3 months, £350 for 6 months and £600 for an annual permit. Disabled resident parking permits will be issued free. Residents’ visitor permits will be available.
4. The Orders will also designate disabled resident parking places elsewhere in the existing Market Street CPZ for use only by persons who are resident within the CPZ, who meet the current criteria for provision of parking places for disabled persons and who display Disabled Resident Parking Permits on their vehicles. Certain other vehicles may wait in the parking places in certain circumstances, e.g. to load or unload goods or pick up or set down passengers. Parking places will be designated outside Nos. 8 and 20 Langdon Crescent and No. 20 Pulleyns Avenue.
The designation of permit parking places will be varied to take account of the designation of disabled resident parking places.
5. Market Street CPZ was previously extended to include a length of Pulleyns Avenue and other streets on an experimental basis by Orders made on 15 December 2014 which came into force on 5 January 2015. These Orders will revoke and re-enact the provisions of those Orders so as to form one set of Orders covering these two CPZ extensions.
6. The Orders, which will come into force on 5 October 2015, and other documents giving more detailed particulars of the Orders can be inspected during normal office hours on Mondays to Fridays inclusive at Newham Dockside, 1000 Dockside Road, London E16 2QU until such time as the Orders cease to have effect.

8. If any person wishes to question the validity of any of the Orders or of any of their provisions on the grounds that it or they are not within the powers conferred by the Act, or that any requirement of the Act or of any instrument made under the Act has not been complied with, that person may, within six weeks from the date on which the Order is made, apply for the purpose to the High Court.
9. If the provisions of any or all of the Orders continue in force for a period of not less than six months, the Council will be considering in due course whether the provisions of any or all of the experimental Orders should be continued in force indefinitely by means of an Order or Orders under Sections 6 and/or 45 of the said Act of 1984.
10. Within a period of six months —
(a) beginning with the day on which the experimental Orders came into force; or
(b) if that Order is varied by another Order or modified pursuant to Section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force
any person may object to the making of Orders for the purpose of such indefinite continuation.
11. All objections and other representations relating to the continuation of the Orders must be made in writing. All objections must specify the grounds on which they are made. They should be sent to the Head of Commissioning (Highways and Traffic), London Borough of Newham, 3rd Floor West, Newham Dockside, 1000 Dockside Road, London E16 2QU or by email, quoting the Order title, to: traffic.orders@newham.gov.uk
12. Persons objecting to the continuation of the Orders should be aware that in view of the Local Government (Access to Information) Act 1985, this Council may be legally obliged to make any comments in response to this notice open to public inspection.
