LAND DRAINAGE ACT 1991
THE POWYSLAND INTERNAL DRAINAGE DISTRICT (ABOLITION) ORDER 2015
Notice is hereby given that on the 24 March, Welsh Ministers and the Secretary of State for Environment, Food and Rural Affairs in exercise of the powers conferred upon them by section 3(5) and (7) of the Land Drainage Act 1991, made the Powysland Internal Drainage District (Abolition) Order 2015 (SI 2015/923) confirming the Scheme submitted by the Natural Resources Body for Wales and the Environment Agency under section 3(1) of the Act.
The Scheme makes provision for:
i) Abolition of the Powysland Internal Drainage District.
ii) Creation of a new Internal Drainage District for the Welsh land previously within the Powysland Internal Drainage District.
iii) Provision that the Natural Resources Body for Wales shall be the drainage board in respect of the new district.
iv.) Matters supplemental thereto or consequential thereon.
A copy of the Order may be seen during normal office working hours at the offices of the Environment Agency, Sapphire East, 550 Streetsbrook Road, Solihull B91 1QT, and at the offices of the Natural Resources Body for Wales at Cambria House, 29 Newport Road, Cardiff CF24 0TP and at the offices of the Department for Environment, Food and Rural Affairs, Area 3C Nobel House, 17 Smith Square, London SW1P 3JR, and at the offices of the Welsh Government, Flood and Coastal Erosion Risk Management, Cathays Park, Cardiff CF10 3NQ.
By paragraph 7 of Schedule 3 to the Land Drainage Act 1991, it is provided that if any person aggrieved by an order desires to question its validity on the grounds that it is not within the powers of the Act or that any requirement of the Act has not been complied with he may, within 6 weeks after the publication of this notice, make an application for the purpose to the High Court, and if any such application is duly made, the Court, if satisfied that the Order is not within the powers of the Act, or that the interests of the applicant have been substantially prejudiced by any requirements of the Act not having been complied with, may quash the Order either generally or in so far as it affects the applicants.

Hysbysir drwy hyn, ar 24 Mawrth, fod Gweinidogion Cymru a’r Ysgrifennydd Gwladol dros yr Amgylchedd, Bwyd a Materion Gwledig drwy arfer y pwerau a roddir iddynt gan adran 3(5) a (7) o Ddeddf Draenio Tir 1991, wedi gwneud Gorchymyn Ardaloedd Draenio Mewnol Powysland (Diddymu) 2015 (OS 2015/923) i gadarnhau Cynllun a gyflwynwyd gan Cyfoeth Naturiol Cymru ac Asiantaeth yr Amgylchedd o dan adran 3(1) o’r Ddeddf.
Mae’r cynllun yn darparu ar gyfer y canlynol:
i) Diddymu Ardal Draenio Fewnol Powysland
ii) Creu Ardal Draenio Fewnol newydd ar gyfer y tir yng Nghymru oedd cynt o fewn Ardal Draenio Fewnol Powysland
iii) Darparu mai corff Cyfoeth Naturiol Cymru fydd bwrdd draenio yr ardal newydd.
iv) Materion atodol a chanlyniadol i hynny.
Mae copi o’r Gorchymyn a chopi o’r Cynllun ar gael yn ystod oriau swyddfa arferol yn swyddfeydd Asiantaeth yr Amgylchedd, Sapphire East, 550 Streetsbrook Road, Solihull B91 1QT, ac yn swyddfeydd Cyfoeth Naturiol Cymru yn Nhŷ Cambria, 29 Heol Casnewydd, Caerdydd CF24 0TP ac yn swyddfeydd Adran yr Amgylchedd, Bwyd a Materion Gwledig yn Ardal 3C Tŷ Nobel, 17 Smith Square, Llundain SW1P 3JR, ac yn swyddfeydd Llywodraeth Cymru, Tîm Rheoli’r Risg o Lifogydd ac Erydu Arfordirol, Parc Cathays, Caerdydd CF10 3NQ.
Yn ôl paragraff 7 o Atodlen 3 Deddf Draenio Tir 1991, darperir ar gyfer unrhyw berson y mae gorchymyn yn eu tramgwyddo, eu bod am gwestiynu ei ddilysrwydd o ran nad yw o fewn pwerau’r Ddeddf neu nad yw yn cydymffurfio ag unrhyw ofyniad yn y Ddeddf, y gall, o fewn 6 wythnos wedi cyhoeddi’r rhybudd hwn, wneud cais i’r diben hwn i’r Uchel Lys, ac os caiff unrhyw gais o’r fath ei wneud, y bydd y Llys, os ydynt yn fodlon nad yw’r Gorchymyn o fewn pwerau’r Ddeddf, neu bod buddiannau’r ymgeisydd wedi eu niweidio’n sylweddol drwy fethu â chydymffurio ag unrhyw un o ofynion y Ddeddf, ddiddymu’r Gorchymyn naill ai yn gyffredinol neu i’r graddau y caiff effaith ar yr ymgeisydd.
