NOTICE
NOTICE IS HEREBY GIVEN that Cash4Health Limited (the previous name of which was Forester Health Limited) and BHSF Limited presented an application to the High Court of England and Wales under Part VII of the Financial Services and Markets Act 2000 for an order sanctioning a Scheme for the transfer to BHSF Limited of the insurance business of Cash4Health Limited and making ancillary provisions to implement the Scheme.
Further Information about the Scheme, including copies of an Independent Expert’s Report and a Statement setting out the terms of the Scheme and summarising the Independent Expert’s Report can be obtained, free of charge, by contacting the Management Support Team of Cash4Health Limited and BHSF Limited by telephone on 0121 629 1202 or by writing to Charlotte Taylor, Company Secretary of Cash4Health Limited and of BHSF Limited at Gamgee House, 2 Darnley Road, Birmingham, B16 8TE, and are also available on the website of BHSF Limited at www.bhsf.co.uk/c4htransfer.
If the Scheme is sanctioned by the Court, it will result in the transfer from Cash4Health Limited of the insurance business to BHSF Limited notwithstanding any entitlement that a person would otherwise have to terminate, modify, acquire or claim an interest or right or to treat an interest or right as terminated or modified as a result of anything done in connection with the Scheme. Any such entitlement will only be enforceable to the extent the order of the Court makes provision to that effect.
The application is expected to be heard on Tuesday 28 April 2015 at 7 Rolls Building, Fetter Lane, London EC4A 1NL. Any person, including any person with a Cash4Health Limited policy, with a BHSF Limited policy or with a Saga Health Cash Plan underwritten by BHSF Limited and any employee of Cash4Health Limited or BHSF Limited, who claims to be adversely affected by the carrying out of the Scheme is entitled to appear at the hearing, in person or by legal representative, or to make written representations to the Court.
If you intend to appear at the hearing in person, or to instruct someone to appear on your behalf, you are requested to give notice of your intention to do so in writing, setting out the reasons why you believe you may be adversely affected.
You are requested to send such notice, or if you are not intending to appear in person or by your legal representative, written details of any objections or concerns that you may have as soon as possible and in any event by the close of business on Tuesday 21 April 2015, to the solicitors for Cash4Health Limited and BHSF Limited, Weightmans LLP, of St Philips Point, Temple Row, Birmingham B2 5AF (Ref.
