  • 1 NOTICE IS HEREBY GIVEN that the Council of the London Borough of Waltham Forest on 29th June 2012 made the above mentioned Orders under sections 9 and 10 of the Road Traffic Regulation Act 1984. The Orders will come into force on 16th July 2012.
  • 2 The general effect of the Orders will be:

(1) to introduce 10 Controlled Parking Zones (CPZs) in the London Borough of Waltham Forest, which will be called CPZs G1, G2, G3, G4, G5, G6, G7, G8, G9 and G10, and will include the streets specified in Schedules 1 to 10 of this notice respectively;

(2) within each CPZ—

  • a to ban waiting by vehicles, other than in the parking places provided, between 8 am and 1 pm and between 3 pm and 9 pm on Mondays to Sundays (where indicated by single yellow lines) and also at any time (where indicated by double yellow lines);
  • b to provide on-street parking places which will operate between 8 am and 1 pm and between 3 pm and 9 pm on Mondays to Sundays and be for the use of permit holders’ vehicles in relation to any one of the following permits during these hours: a residents’ permit, a business users’ permit, a visitors’ permit, a school permit, a charity permit, an essential users’ permit or a residents’ foreign vehicles permit which is valid in that particular CPZ (in addition, vehicles displaying a valid disabled person’s blue badge may be parked in the parking places in any of the CPZs, without time limit);

note: in Brisbane Road (G5), the above restrictions and parking controls would not operate when Leyton Orient Football Club match day restrictions operate.

(3) to provide that, on application to the Council and subject to certain conditions being met—

  • a permits will be issued free of charge to eligible (i) residents who live in and (ii) business users and essential users who work in, a CPZ, provided that the application for a residents’ permit or an essential users’ permit is in respect of a vehicle having eight passenger seats or less, a goods-carrying vehicle (not exceeding 2.3 metres in height or 5.25 metres in length), a motor cycle or an invalid carriage and the application for a business user’s permit is in respect of a vehicle not exceeding 1950 kilograms in weight [note: the permits issued will be specific to one CPZ and will not be transferable for use in any other CPZ;
  • b “single use” visitor permits will be available (free of charge) to any resident eligible to apply for a residents’ permit; each permit will be valid for use by their visitors on any one day only, for either up to 5 hours between 8 am and 1 pm, or up to 6 hours between 3 pm and 9 pm, on Mondays to Sundays (per household, a maximum of 4 permits per week will be available during the Olympic Games and also during the Paralympic Games and a maximum of 8 permits per week during the period of 13th August 2012 to 26th August 2012.;
  • c a “multiple-use” visitor permit to leave a specified vehicle in a parking place will be available (free of charge) to any resident eligible to apply for a residents’ permit; it will be valid for use by their visitors during the Olympic Games and Paralympic Games only;

(4) that the permit system would mainly operate as a “virtual” permit system where the registration marks of vehicles permitted to park in the on-street parking places will be held by the Council or the London Organising Committee of the Olympic Games and Paralympic Games on a list of vehicles authorised to park in the CPZs. Hard copy permits may also be available in certain circumstances;

(5) to provide short-stay parking places in certain various roads, which will operate between 8 am and 1 pm and between 3 pm and 9 pm on Mondays to Sundays and be for the free use of vehicles for periods of up to 30 minutes at a time, with no return to the parking place within 2 hours of leaving it.

  • 3 Where it appears necessary for certain purposes, the Council may, in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, modify or suspend any provision of the experimental Traffic Orders while they are in force.
  • 4 The reasons for the Orders are as follows: The Olympic and Paralympic Games will attract large numbers of spectators and commuters, some of whom may try to park as close as they can to the Olympic Park. In the first instance, the Orders are intended to discourage such parking and preserve parking facilities for residents and businesses in the area, which has also provided an opportunity to assess whether in the light of experience, some or all of the experimental measures need to be suspended, changed or made permanent at a later date. [note: before making any decision on permanent re-instatement of any of the experimental measures after the Games, whether in full or in part, the Council will consult with local residents and businesses on whether to do so].
  • 5 The Orders and documents giving more detailed particulars of them are available for inspection between 9.30 am and 4.30 pm on Mondays to Fridays inclusive (except Bank Holidays), from 2nd July 2012 until the Orders cease to have effect, at (a) The Information Desk, Town Hall, Forest Road, Walthamstow, E17 and (b) Low Hall, Argall Avenue, London, E10 7AS.
  • 6 The Council will be considering in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of permanent Orders made under sections 6, 45, 46 and 49 of the Road Traffic Regulation Act 1984. Any person may object to the making of such permanent Orders for the purpose of such indefinite continuation within a period of six months beginning with the day on which the experimental Orders come into force or, if the Orders are varied by another Order or Orders or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force. Any such objection must be made in writing and must state the grounds on which it is made and be sent to Traffic Orders, Environment and Regeneration, Low Hall, Argall Avenue, London, E10 7AS. Any objection may be communicated to, or be seen by, other persons who may be affected.
  • 7 If any person wishes to question the validity of any of the Orders or of any of their provisions on the grounds that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Orders are made, apply for the purpose to the High Court.
