TOWN AND COUNTRY PLANNING ACT 1990

The Secretary of State for Transport hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-Up of Highways (County of Derbyshire) (No 7) Order 2006” authorising the stopping-up of lengths of highway at Penncroft Lane, Lynam Close, Upper Croft, Middle Lane and Nethercroft Lane, Danesmoor, Chesterfield, Derbyshire measuring a maximum length of 435 metres in total. The stopping-up is authorised only in order to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Lovell Partnerships Ltd by North East Derbyshire District Council on 14 November 2005 under Ref 05/00744/FL. The Order requires the provision of a new highway and the improvement of existing highway by Lovell Partnerships Ltd maintainable at public expense, and for which the highway authority is to be the Derbyshire County Council. Copies of the Order may be obtained, free of charge, by applying to the Government Office for the East Midlands, Transport Policy, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham NG1 5GG (quoting Ref EMCM 505035/1/289) and may be inspected at all reasonable hours at the offices of the Clay Cross Library, Holmgate Road, Clay Cross, Chesterfield, Derbyshire. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 27 April 2006, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
