The Secretary of State hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping-Up of Highways (County of Derbyshire) (No 5) Order 2004” authorising the stopping-up of various lengths of highway measuring a total of 177 metres long and various lengths of footpath measuring a total length of 1,485 metres at Pavilion Road, Hopewell Farm, Cotmanhay, Ilkeston, Derbyshire. The stopping-up is authorised only in order to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Erewash Housing Ltd by the Erewash Borough Council on 14 December 2001 under Ref ERE/1001/0067. Copies of the Order may be obtained, free of charge, by applying to the Government Office for the East Midlands, Planning & Transport, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham NG1 5GG (quoting Ref EMCM 507035/1/256) and may be inspected at all reasonable hours at the Ilkeston Library, Market Place, Ilkeston, Derbyshire. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 16 September 2004, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
