THE LEWISHAM (WAITING AND LOADING RESTRICTION) (AMENDMENT NO 62) TRAFFIC ORDER 2002

1. Notice is hereby given that Lewisham Council made these two Orders in accordance with the provisions of sections 6 and 45 to 47 of the Road Traffic Regulation Act 1984 and sections 66 to 74 of the Road Traffic Act 1991 on the 4 February 2002. Both Orders come into force on 4 March 2002. 2. The general effects of the two Orders is respectively to introduce revisions to the Lewisham Controlled Parking Zone and waiting and loading restrictions in the central Lewisham area, revoking the Lewisham (Special Parking Area) (Parking Places) (No 1) Order 1993 and the Lewisham (Special Parking Area) (Free Parking Places) (No 1) Order 1993 and installing: (1) A controlled parking zone operating from 9.00 am to 6.30 pm on Mondays to Saturdays inclusive: (a) Designating parking places in: Albion Way, Belmont Grove, Belmont Hill, Belmont Park westward from No 29 Blackheath Rise, Blessington Road, Bonfield Road, Boyne Road, Campshill Road, Caterham Road, Church Grove, Clarendon Rise, College Park Close, Conington Road south of Morden Hill, Courthill Road, Cressingham Road, Dermody Gardens, Dermody Road, Eastdown Park, Eliot Hill, Eliot Park, Elmira Street, Gilmore Road, Granville Grove, Granville Park southward from No 6 Holly Hedge Terrace, Leahurst Road, north from No 9 Lewisham Hill, Lingards Road, Limes Grove, Lockmead Road, Longbridge Way, Marischal Road, Mercator Road, Mercia Grove, Middleton Way, Morden Hill south side west of Lewisham Road, Morley Road, Oakcroft Road, Prince’s Rise, Rennell Street, Romborough Way, St Austell Road, St Stephen’s Grove, Silver Road, Slaithwaite Road, Walerand Road, Wearside Road, Whitburn Road, and Wisteria Road; (b) Provisions will be predominantly residents’ parking places with, at certain locations, some dedicated “pay-and-display” parking places and some shared use parking places, shared use to be between residents’ and business permit holders and “pay-and-display parking: (c) Residents and businesses in the lengths of road listed at (a) above and at Campshill Place, Clipper Way, Cornmill Lane, Engate Street, Hither Green Lane north of Ryecroft Road, Junction Approach, Ladywell Road, east of bridge over railway, Lee High Road northwest of Eastdown Park, Lewis Grove, Lewisham High Street north of Romborough Way, Loampit Vale east of Elmira Street/Thurston Road, Molesworth Street, Myron Place, Romborough Gardens, Station Road and Vian Street are eligible to apply to Lewisham Council for, respectively, resident’s or business permits. (2) Supporting waiting restrictions (by amendment to the Lewisham (Waiting and Loading Restriction) Order 1990). (a) “No waiting 9.00 am to 6.30 pm Mondays to Saturdays” in most streets in the controlled zone; (b) “No waiting 8.00 am to 6.30 pm Mondays to Saturdays” and certain loading restrictions to be retained on certain roads and main roads/bus routes through the zone; (c) “No Waiting At Any Time” and certain no loading at any time restrictions to be retained or introduced in certain easily obstructed or congested lengths of road. 3. Charges will be: (a) Parking charges at designated permit holders’ parking places: (i) Resident’s parking permit: £25 per year (for use of residents’ parking places); (ii) Resident’s carer’s permit: £25 per year (for use of residents’ parking places); (iii) Visitor’s parking permit: £1 per half day (up to 5 hours); £2 per day; £5 per week (for visitors’ use of residents parking places); (iv) Business user’s permit: £450 per year; (b) “Pay-and-Display” charges 20 pence miniumum charge for up to 20 minutes, then pro rata at 10 pence per 10 minutes to £2.40 for maximum initial period of 4 hours (disabled badge holders exempt from “Pay-and Display” charges): (c) Additional parking charges: for contravention of parking conditions (charges current in the borough will apply); (i) Penalty charge: £80 for contravention (eg: no valid ticket or permit, as appropriate, correctly displayed in parking place, incorrectly parked in a parking place, contraventions of waiting and loading restrictions, etc) to be paid within 28 days, discounted by 50% to £40 if paid within 14 days; (ii) Fee for release of vehicle from wheelclamp: £45 plus penalty charge; (iii) Fee for release of removed vehicle from car pound: £125 plus penalty charge; (iv) Fee for storage of removed vehicle: £15 per day from midnight day after removal; (v) Fee for disposal of removed vehicle not reclaimed: £60. 4. Exemptions from the restrictions include: loading and unloading up to 20 minutes, picking up and setting down passengers up to 2 minutes, Council and statutory undertakers’ vehicles engaged on various statutory duties, stopping to avoid an accident, police, fire brigade and ambulance service vehicles in an emergency and anything done with the permission or at the direction of a police constable in uniform. 5. Copies of documents giving more detailed particulars of the two Orders and measures can be inspected from 10.00 am to 4.00 pm on Mondays to Fridays at the office of Lewisham Highways Development, Wearside Service Centre (Fleet Building 1st Floor) Wearside Road, Ladywell, London SE13. 6. Anyone wishing to question the validity of either Order or of any of their provisions on the grounds that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or of any Instrument or relevant regulation made under the Act, has not been complied with may, within 6 weeks from the date on which the Order was made, apply for the purpose to the High Court.
