HARBOURS ACT 1964 (AS AMENDED)
PROPOSED BRIGHTLINGSEA HARBOUR REVISION ORDER

Notice is hereby given that Brightlingsea Harbour Commissioners have applied to the Secretary of State for Local Government, Transport and the Regions to make a Harbour Revision Order under section 14 of the Harbours Act 1964.
The Order will alter the constitution of the Commissioners.
The object of the proposed Order is to give effect to the guidance contained in the government report “Modernising Trust Ports—Guide to Good Governance”.
The previous constitution provided for ten commissioners to be appointed by various representative bodies and one commissioner to be elected by certain landowners. The new constitution provides for a body of eight commissioners of whom six are to be appointed by a specially formulated appointments panel. In addition, the Chief Executive and the Harbour Master are to be commissioners thereby securing executive representation on the Commissioners. The Order also makes provision to govern the selection and appointment of commissioners and the matter in which they are to conduct business. The objective of the new constitution is to obtain a body of commissioners that is independent and fit for purposes rather than representative of particular interests. This will ensure that persons appointed to serve as commissioners are independent, selected in an open and accountable manner, and are fit for the purpose of providing the Commissioners with effective strategic direction.
The new constitution date will be 1 October 2002 or the date when the Order comes into force, whichever is the later.
The proposed Order would not authorise a project. Accordingly Council Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment (as amended by Council Directive 97/11/EC) does not apply to the proposals and no environmental statement has been supplied with the application.
A copy of the draft Order which accompanied the application may be inspected between the hours of 9.00 am and 1.00 pm Monday to Friday, at the offices of the Brightlingsea Harbour Commissioners, 4 Copperas Road, Brightlingsea, Essex CO7 0AP, telephone 01206 302200.
A copy of the draft Order is also available for inspection at the Ports Division of the Department of Transport, Local Government and the Regions, Great Minster House, 76 Marsham Street, London SW1P 4DR.
Any person desiring to make an objection or representation to the Secretary of State concerning the application should, within forty-two days from the date at the foot of this notice write to the Secretary of State, Department of Transport, Local Government and the Regions, Ports Division, c/o Mike Davey, Zone 2/31 Great Minster House, 76 Marsham Street, London SW1P 4DR or by fax 020-7944 2188, or e mail mikedavey@dtlr.gsi.gov.uk, quoting Ref P89/3/406, stating the grounds of their objection or representation.
