The Harrow (Free Parking Places) (Disabled Persons) Traffic Order 19
Notice is hereby given that on 22nd June 1998 the Council of the London Borough of Harrow made the above-mentioned Order under sections 6, 124 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985 and all other enabling powers. The general effect of the Order would be to revoke and consolidate the existing provisions of the Harrow (Free Parking Places) (Disabled Persons) Traffic Order 1994 with additional new spaces listed in Schedule 1 and the permanent revocation of the existing spaces listed in Schedule 2 to this notice. In addition it will clarify the position of vehicles stopping so as to overlap disabled persons parking spaces and to be within marked spaces in parking places. The prohibitions in the Order will not apply in respect of anything done at the direction of a police constable in uniform or a traffic warden or with the permission of a parking attendant or other person duly authorised by the Council or in the following circumstances: (a) the vehicle is waiting for a period not exceeding two minutes or such longer period as a parking attendant may approve to enable a person to board or alight from the vehicle or load thereon or unload therefrom his personal luggage. Provided that if the said person is a person suffering from any disability or injury which seriously impairs his ability to walk, or who is blind, the vehicle may wait for so long as may be necessary to enable the person to board or alight from the vehicle or load thereon or unload therefrom his personal luggage; or (b) the vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond his control or to such waiting being necessary in order to avoid an accident; or (c) the vehicle is used for fire brigade, ambulance or police purposes or, not being a passenger vehicle, is being used in the service of a local authority in pursuance of statutory powers or duties provided that in all the circumstances it is reasonably necessary in the exercise of such powers or the performance of such duties for the vehicle to wait in the parking place in which it is waiting; or (d) the vehicle is waiting only for so long as may be necessary to enable it to be used in connection with the removal of any obstruction to traffic; or (e) the vehicle is waiting while postal packets addressed to premises adjacent to the parking place in which the vehicle is waiting are being unloaded from the vehicle or, having been unloaded therefrom, are being delivered, or while postal packets are being collected for loading on the vehicle from premises or posting boxes adjacent to the parking place in which the vehicle is waiting or, having been so collected, are being loaded thereon; or (f) the vehicle not being a passenger vehicle is waiting only for so long as may be necessary to enable it to be used for the purpose of any building operation, demolition or excavation adjacent to the parking place, the maintenance, improvement or reconstruction of the highway or the cleansing of gullies in or adjacent to the parking place, the laying, erection, alteration or repair in or adjacent to the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line or the placing, maintenance or removal of any traffic sign; or (g) the vehicle is in actual use in connection with the removal of furniture to or from one office or dwelling-house adjacent to the parking place from or to a depository or another office or dwelling-house; or (h) in any other case the vehicle is waiting for the purpose of delivering or collecting goods or loading or unloading the vehicle at premises adjacent to the parking place in which the vehicle is waiting the vehicle does not wait for such purpose for more than twenty minutes or such longer period as a parking attendant may approve. A copy of the Order, which will come into operation on 29th June 1998, and of the Harrow (Free Parking Places) (Disabled Persons) Traffic Order 1994 (and of the Orders which have previously amended that Order) and documents giving more particulars of the Order are available for inspection during normal office hours on Monday to Fridays inclusive until the end of 6 weeks from the date on which the Order was made in Third Floor Reception at the Civic Centre at the address below. If any person wishes to question the validity of the Order or of its provisions on the grounds that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of the Act or of any Instrument made under the Act has not been complied with, that person may, within 6 weeks of the date on which the Order is made, apply for the purpose to the High Court. Abbey Close, the west side, between a point opposite the southern wall of Nos. 38 and 40 Abbey Close and a point 5.5 metres north of that point. Alexandra Avenue, the service road on the east side, fronting Nos. 302 to 332 between a point 14 metres north of the northern wall of No. 332 Alexandra Avenue and a point 11 metres south of that point (2 spaces). Belmont Road, the south side, between a point opposite the party wall of Nos. 13 and 15 Belmont Road and a point 5.5 metres west of that point. Bernays Close, the west and south sides, between a point 9 metres south of the extended southern kerb-line of the west to east arm of Bernays Close and a point 5.5 metres south of that point. Claire Gardens, the east side, between a point 4 metres north of a point opposite the southern wall of Nos. 13 and 14 Claire Gardens and a point 5.5 metres south of that point. Dowding Place, the south side, between a point 15 metres east of the extended eastern kerb-line of The Chase and a point 5.5 metres east of that point. Elmgrove Crescent, the north-west side, between a point opposite the party wall of Nos. 11 and 13 Elmgrove Crescent and a point 6 metres north-east of that point. Frognal Avenue, the east side, between a point opposite the party wall of Nos. 4 and 6 Frognal Avenue and a point 5.5 metres south of that point. Graham Road, the north side, between a point opposite the party wall of Nos. 25 and 27 Graham Road and a point 5.5 metres west of that point. Grant Road, the south side, between a point 8.5 metres west of the extended western kerb-line of Byron Road, Wealdstone and a point 11 metres west of that point (2 spaces). Kingsley Road, the south side, between a point opposite the party wall of Nos. 34 and 36 Kingsley Road and a point 5.5 metres east of that point. Masons Avenue, the north side between a point opposite the party wall of Nos. 65 and 67 Masons Avenue and a point 5.5 metres east of that point. St. John’s Road, from a point 6 metres south-east of a point opposite the north-western wall of No. 284 Station Road, Harrow between the north-western kerb-line to a point 7 metres north-east of that kerb-line for two vehicles at right angles to the closed section of road.
