NOTICE OF REVOCATION OF SMOKE CONTROL ORDERS AND PROPOSAL TO CREATE A BOROUGH-WIDE SMOKE CONTROL ORDER.
THE CHESTERFIELD BOROUGH COUNCIL SMOKE CONTROL ORDERS (REVOCATION) ORDER 2025
1. Notice is hereby given that Chesterfield Borough Council (“the Council”) in exercise of its powers under section 18 of, and Part III of Schedule 5 to the Clean Air Act 1993, as amended (“the Act”),
a) propose to make an order entitled "Chesterfield Borough Council SMOKE CONTROL ORDERS (REVOCATION) ORDER 2025" (the Revocation Order) declaring the revocation of the smoke control orders listed at schedule 1 and schedule 2, subject to consideration by the Council of any objections, which are not withdrawn; and
b) propose to make an order entitled “Chesterfield Borough Council SMOKE CONTROL ORDER 2026 (the Proposed Order) declaring the whole of the administrative area of the Council shall be a smoke control area for the purposes of the Act, subject to consideration by the Council of any objections, which are not withdrawn.

2. The effect of the Revocation Order is to
a) revoke existing smoke control orders put in place before 13th November 1980, that are in operation in the administrative area of the Council set out in Schedule 1, subject to confirmation by the Secretary of State; and
b) revoke existing smoke control orders put in place after 13th November 1980, that are in operation in the administrative area of the Council set out in Schedule 2, subject to confirmation by the Secretary of State.
4. If confirmed, it will remove all smoke controls for those parts of the Council’s administrative area previously declared smoke control areas as set out in Schedule 1 and Schedule 2. If the Revocation Order is confirmed, with or without modification, it will not come into operation any earlier than six months from the date of confirmation by the Secretary of State.
5. Objections to the confirmation of the Revocation Order or the Proposed Order must be sent to the Secretary of State on or before 17th June 2025 at:

6. All objections should be clearly headed ‘Chesterfield Borough Council - Objection of revision to Smoke Control Orders'.
7. Copies of the Revocation Order and the Proposed Chesterfield Borough Council Smoke Control Order 2026 may be inspected free of charge at the Town Hall, Rose Hill, Chesterfield, Derbyshire, S40 1LP at all reasonable times during the period of six weeks from 6th May 2025 and on the Council’s website.
