INTRODUCTION OF PENALTY CHARGE NOTICE PARKING ENFORCEMENT THROUGHOUT HOUSING ESTATE ROADS AND CAR PARKS

THE LONDON BOROUGH OF SOUTHWARK (HOUSING ESTATE ROADS AND CAR PARKS) (NO. 2) ORDER 2013

  • 1 NOTICE IS HEREBY GIVEN that the council of the London Borough of Southwark on 27 June 2013 made the above-mentioned order under sections 6, 32, 33, 35, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended.
  • 2 The general effect of the order will be to formalise existing parking restrictions throughout housing estate roads and housing estate car parks in the London Borough of Southwark, so as to allow for penalty charge notice parking enforcement under the provisions of the Traffic Management Act 2004. These restrictions will be:
    • a No vehicles may park in any area indicated as being ‘no waiting at any time’ (on an estate road) or a ‘restricted area’ (within a housing estate car park) by the marking of either double-yellow lines, cross-hatching or ‘keep clear’ markings;

Exemption to the preceding restrictions will be made for loading/unloading and visiting disabled person’s vehicles displaying a valid ‘blue badge’, provided no vehicle shall load/unload or park so as to obstruct the free movement of vehicles and pedestrians or access to any part of a housing estate road or housing estate car park or parking bay or entrance to premises in or adjacent to that housing estate road or car park.

  • b Where parking bays are marked, all vehicles must be parked within the limits of a marked parking bay;
  • c Where no parking bays are marked, vehicles may park in any area other than an area indicated as being ‘no waiting at any time’ or a ‘restricted area’, provided that no vehicle may to be parked so as to obstruct the free movement of vehicles and pedestrians or access to any part of a housing estate road or housing estate car park or parking bay or entrance to premises in or adjacent to that housing estate road or housing estate car park;
  • d Where its is indicated that a housing estate permit parking scheme is in operation, all vehicles left in parked (other than those left in marked visitor’s or disabled person’s parking bays) must display a valid permit relating to that housing estate permit parking scheme;
  • e Where a parking bay is marked as being for visitors, vehicles may be left for a maximum stay of 3 hours only;
  • f Where a parking bay is marked as being for disabled persons only, only vehicles displaying a valid ‘blue badge’ may be left in that parking bay; and
  • g Where a parking bay is marked as being for motor cycles only, only vehicles of that class may be left in that parking bay.

Penalty charge notices will be issued where any contraventions to these restrictions occur. The same procedure and rights of appeal will apply as if these penalty charge notices were issued on the public highway or in one of the council’s public car parks.

  • 4 Any persons desiring to question the validity of the orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the orders may, within six weeks of the date on which the orders were made, make application for the purpose to the High Court.
